Özet
Ceza Hukukunda akıl hastalığı ceza sorumluluğunu ortadan kaldıran veya önemli derecede azaltan sebeplerden sayılmaktadır. Akıl hastalığı kusur yeteneğini ortadan kaldırmaktadır. Bu nedenlerden dolayı suç işleyen akıl hastalarının ceza sorumlulukları yoktur. Suçlunun ceza sorumluluğu veya azaltılmış ceza sorumluluğu uzman bilirkişinin vereceği rapor eşliğinde mahkeme veya hâkim tarafından belirlenecektir. Suç teşkil eden eylemi gerçekleştirdiği sırada akıl hastası olan suçlunun ceza sorumluluğu olmayacaktır. Bunlar hakkında akıl hastalarına özgü güvenlik tedbirleri uygulanacaktır. Özellikle toplumda infial yaratan ağır suçlar işleyen suçluların akıl hastalığı taklidi yaparak cezaevinden kurtulma yolu olarak kullanılmasının da önüne geçilmelidir.
In criminal law, mental ilness are considered that reducing or eliminating the cirminal liabitlity significantly. Mental illness abolishes the defect of talent. For these reasons, there are no criminal responsibility of the mentally ill people who commit crimes. The criminal liability or a reduced criminal responsibility are determinded by courts or judge accompained with the report is given expert professionals. There is no criminal liability of the guilty person who mentally ill while performing criminal acts. Specific security precautions of mentally illa re applied to these quilties in this case. Especially criminals, who commit serious crimes that creat an outrage in society, should be prevented using imitation as a way to escape from prison by mental illnesses.
