Özet
Azmettirme, Türk Ceza Kanunu Birinci Kitabın İkinci kısmında, ?Suça İştirak? başlıklı dördüncü bölümünde düzenlenmiştir. İlgili hükme göre (TCK m.38); ?Başkasını suç işlemeye azmettiren kişi, işlenen suçun cezası ile cezalandırılır?. Azmettirme müessesesi ceza hukuku bağlamında büyük önemi haizdir. Kanun koyucular suça neden olunmasının tüm toplum için tehlikeli olduğu gerekçesi ile suçun arkasındaki gerçek kişiyi de cezalandıracak hükümleri kanunlara koymuşlardır.
Instigation of a crime has been regulated under the title of ?Participation in Crime? in the fourth part of the second chapter of the first book of the Turkish Penal Code No 5237. Instigation of a crime is penalized under the Article 38. According to Turkish Penal Code No 5237, Article 38; ?The person who instigate another one to commit the crime shall be sentenced with that particular crime.? The instigation of a crime is of great importance in criminal law due to the fact that the action penalized by the lawmakers is ?cause a crime? and for this reason, it is a type of participation which concerns the whole society, and the individuals who might commit the crime in question are back stage of a crime.
