İfade özgürlüğü, basın özgürlüğü, bilgi edinme hakkı, eleştiri hakkı gibi birçok hakkın elde edilmesinde ve korunmasında bir önemli bir unsurdur. İfade özgürlüğü bu öneminden dolayı Avrupa İnsan Hakları Mahkemesi ve Anayasa Mahkemesi’nin birçok davasının konusunu oluşturmuştur. Bu çalışma ile de Avrupa İnsan Hakları Mahkemesi ve Anayasa Mahkemesi kararları ışığında ifade özgürlüğünün amacı, kapsamı ve sınırları belirlenmeye çalışılmıştır.Freedom of expression is a right protected by Article 10 of the European Convention on Human Rights and by Articles 25 and 26 of 1982 Constitution of the Republic of Turkey under the title of Fundamental Rights and Duties. The right for freedom of expression is an important factor in obtaining and protecting many rights such as the right to freedom of press, the right to information and the right to criticise. Freedom of expression has been the subject of many cases of European Court of Human Rights and Constitutional Court due to this importance.
