Öğe CONTROL OF CONTENTS OF THE BROADCASTS IN TURKISH LAW(INT ORGANIZATION CENTER ACAD RESEARCH, 2016) Yildiz, SevilMedia, which has big effect at the formation of the culture at the societies having democratic management system, is qualified as the fourth power after legislation, executive and jurisdiction. Audiovisual media, when their functions are taken into account in addition to their political effects, is accepted as the most effective tool of the mass media. For the audiovisual media, wide spreading and becoming an integral part of society life in process of time, to perform its functions in a healthy way, the regulation and control of this field have become a state of important necessity. In Turkish Law Radio and Television Supreme Council, performing the control of audiovisual media, is an independent administrative authority. RTSC has become a constitutional institution with the inclusion of an additional paragraph inserted into article 133 of the Constitution by means of the Law no 5370. Authorized by the Law no 6112 on the Establishment and Broadcasting of Radio and Television Companies to release the broadcasting companies, to inspect the organizations and to impose sanctions in cases of violation of the provisions, the decisions of RTSC are subject to judicial review. The control of the contents of broadcasts by the Council is examined in this study. In the control of broadcasts, the direct control, audience based and self control-joint control practices have been considered. Recommendations upon the control systems being applied in Turkey have been made. Also with self regulation and co-regulation practices, general trend towards more effective and successful applications of the control mechanism through the shared responsibility between supervisory authorities and the independent broadcasters has also determined.Öğe THE MODEL OF TURKEY IN LEGAL PROTECTION OF CULTURAL HERITAGE(COPERNICUS GESELLSCHAFT MBH, 2010) Yildiz, SevilBy the developing of the concept of common heritage of humanity in the international community, the idea of the development of natural or man-created precious, carrying the universal values that belong to a single state is abandoned. Such cultural artifacts are accepted as the common heritage of all humanity. The international enforcement efforts which are being executed by this purpose and organizations are created are encouraging the protection of world cultural heritage and transferring to future generations. Legal actions are required to transmit world cultural heritage to future generations because of the facing technological, natural or man-made threats of world cultural heritage. Protection of cultural heritage by legal ways is the base of all protection ways. Significant changes in existing law are made for the protection of cultural assets in the last period in Turkey. After international agreements are signed by Turkey, our national legislation is must be determined compliance with international law in the process of integration of cultural assets with contemporary life. In this study, national legislation of Turkey are examined which are based on conservation of our cultural assets that composes our cultural heritage and transfer of assets to future generations. It is aimed to provide contribution to compliance by international contemporary approach and application principles in this study.Öğe STATE SUPPORT PROVIDED TO CINEMA FILMS IN TURKISH LEGAL SYSTEM(INT ORGANIZATION CENTER ACAD RESEARCH, 2017) Yildiz, SevilCinema politics is based on the combination of the different features such as interaction with society international circulation, industry specific settlement, and relationship with technology, industry, art, and mass media. The policies created for the cinema field are under the influence of economic and cultural values. Interventionism, protectionism and support should be assessed in this context in the field of cinema. From the beginning until 1987, Turkish cinema has been developed and developed with its own internal dynamics without being supported by the state. The Turkish cinema has developed its own production style without rely on the non-sector capital and with the domestic audience in the domestic market without receiving state support. State support to the cinema which has been recently restructured has been provided by the Law No. 5224 on the Evaluation, Classification and Supporting of Cinema Films. It is the first time that Turkish cinema has a Law. It has been accepted in the Assembly that it is a sector in which cinema is supposed to be supported and promoted. The purpose of this study to assert the film support systems briefly and particularly present a general evaluation of the consequences the Regulations for Supporting as well as Supervising and Classifying the Cinema Films on the basis of the Law No. 5224 pertaining to the Evaluation, Classification and Support of the Cinema Films with respect to the Turkish cinema in the frame of cinema policies.
