Özet
Devlet memurları, Devlet Memurları Kanunu 'na göre çalışan görevlilerdir. Memurlar ile idare arasındaki ilişki, bu kanun çerçevesinde belirlenir. Kanun, memurlara birtakım haklar tanıdığı gibi birtakım yükümlülükler de getirmiştir. Yükümlülüklerini ihlal eden memur, disiplin suçu işlemiş sayılır. Disiplin suçu işleyen memurlar hakkında disiplin soruşturması yürütülür ve disiplin cezası verilir. İdarenin objektifliğini sağlamak açısından, disiplin hukukuna ilişkin bazı temel ilkeler mevcuttur. Disiplin soruşturması yürüten idare, disiplin suç ve cezaları ve disiplin soruşturmasına hakim olan temel ilkelere uygun hareket etmelidir. Bu temel ilkeler, mevzuat ve yargı kararlarıyla ortaya çıkmıştır. Bunların belki de en önemlileri yargı yolu güvencesi ve savunma hakkıdır. Bu ilkelere uyulmaması, disiplin cezasının iptali sonucuna neden olur.
Civil servants are the officials who work under the State Civil Servant Act. The relationship between the civil servants and the administration is formed by this act which has given civil servants some rights as well as introduced some obligations upon them. The civil servants who have breached obligations are considered as committed disciplinary offences. The civil servant who has been found in breach of the obligation as a result of the disciplinary inquiry is given disciplinary penalty consequently. There are some fundamental principles to make sure the administration operates, in an objective manner. The administration which conducts disciplinary inquiry is required to follow the fundamental principles paramount in civil servant disciplinary inquiries, offences and penalties. These principles are the product of legislation and court decisions. Probably the most important ones of these principles are the right to defend himself and to recourse to judicial review of the civil servant. Breach of these principles result in the annulment of the disciplinary penalty.
