dc.description.abstractÖz Hukuk Muhakemeleri Kanunu’nun 224’üncü maddesinde yabancı resmî belgelerin yetkili makamlar tarafından onaylanması zorunluluğuna ilişkin düzenleme yapılmıştır. Kanun’un aynı maddesinde yabancı resmî belgelerin onaylanması ile ilgili Türkiye’nin taraf olduğu milletlerarası sözleşme hükümlerinin saklı olduğu belirtilmiştir. Yabancı ülke mahkemeleri tarafından verilen kararların Türkiye’de kesin hüküm etkisinin kabulü için, bu kararların kural olarak mahkemeye başvurularak tanıma ya da tenfizinin talep edilmesi ve mahkeme tarafından bu talebin kabul edilmesi gerekmektedir. Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun’un 53’üncü maddesinde ise bu yönde talepler için hazırlanan dilekçeye eklenecek belgelerle ilgili düzenleme yapılmıştır. Kanun’un 1(2)’inci maddesinde Türkiye Cumhuriyeti’nin taraf olduğu milletlerarası sözleşme hükümleri saklı tutulmuştur. Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun’un 53’üncü maddesinde aranan onay zorunluluğu ile ilgili hüküm, Hukuk Muhakemeleri Kanunu’nun 224’üncü maddesinde aranan onay zorunluluğuna ilişkin hükümle karıştırılabilmektedir. Bu durumun nedenlerinden biri yabancı ülke makamı ifadesinden ne anlaşılması gerektiğinin açık olmamasıdır. Diğeri ise her iki düzenlemede yer alan hükümler arasında uyumsuzluk bulunmasıdır. Çalışmada konuyla ilgili değerlendirmeler yapılarak, çözüm önerileri getirilmesi amaçlanmaktadır.en_US
dc.description.abstractAbstract Under Article 224 of the Code of Civil Procedure, foreign official documents are required to be approved by the competent authorities. The same article of the Law also states that the provisions of international conventions to which Türkiye is a party concerning the approval of foreign official documents are reserved. The recognition or enforcement of judgments rendered by foreign courts must be requested through an application to the court and approved by the court in order for the judgments to be considered final judgments in Turkey. A petition for such a request must be accompanied by appropriate documents in accordance with Article 53 of the act on International Private Law and Procedural Law. In accordance with Article 1(2) of the Law, the provisions of international conventions to which the Republic of Türkiye is a party are also reserved. It is common to confuse the obligation of consent under Article 53 of the Code on Private International Law and Procedural Law with the obligation of consent under Article 224 of the Code of Civil Procedure. This is due to a lack of clarity regarding what should be understood by the term "foreign authority". Another reason of confusion is the incompatibility between the provisions of the two regulations. The purpose of this study is to make evaluations on the subject and to offer solutions.en_US
