Abstract
Çalısmamızda bn Rüsd'ün hilaf kitabı niteliginde olan Bidâyetü'l-Müctehid adlı eserinde Ebû Hanife'ye ait olarak naklettigi görüsleri tahkik etmeye çalıstık. Tezimizde de bahsettigimiz üzere bir mezhebe mensub bir alimin baska bir mezhebin görüsünü naklederken bazı hatalara düstügü görülür. Bunların sebepleri arasında mezhebî taassub, objektif olamama, diger mezhebin ana kaynaklarına ulasamama, ıstılah farklılıgından dogan yanlıs anlasılmalar, herhangi bir kaynaga dayandırılmadan zihindeki kanaatle yetinme gibi durumlar sayılabilir. bn Rüsd'dün de eserinde mam Ebû Hanife'nin görüslerini verirken bazı hatalara düstügü görülür. Bu hatalar mezhebî taassub ve objektif olamamaktan kaynaklanmamaktadır. Bidâyetü'l-Müctehid'de mam Ebû Hanife'ye dair 974 görüs incelenmis olup, 94 hatalı görüs tespit edilmistir. Bunlar 1. bölümde Hadesten Taharet, Namaz, Oruç, 'tikaf, Hac, Cihad, Kurban, Sayd konularında ; 2. bölümde Nikah ve Talak, Zıhar konularında, 3. bölümde Büyu', Kırâd, care, Kısmet, vekalet, vedia, Feraiz ve Kitabet konularında; 4. bölümde Diyât, Sirkat, Cirah, Zina ve Akdiye konularındadır.
In our study, we tried to investigate bn Rüsd?s attributions to mam Ebû Hanife in his book Bidâyetü?l-Müctehid. As we mentioned in our thesis, it can be seen that a scholar from one madhab may fall into error when he quotes an idea from another scholar from another madhab. These mistakes stem from fanaticism of madhab and being subjective. In addition, these mistakes are generally about bn Rüst?s own ideas that he tells under the expression of ?in my opinion?. In Bidâyetü?l-Müctehid, 974 notions about mam Ebû Hanife are studied and 94 of them were determined as false. These notions are classified in four chapters. In the first chapter, there are ablution, prayer, fast, fretiring into a mosque or house for devotion, pilgrimage, jihad and victim pray. In the second chapter, there are marriage and divorce. In the third chapter, there are exchange, sleeping partnership, preemption, proxy, to comment, article found and shares in estate. In the fourth part, there are blood money, to injure, adultery, theft and to give evidence of contract.
