| dc.description.abstract | Devlet klasik kamu hizmetlerini özel hukuk kişilerine gördürme noktasında, bulunulan döneme göre bir tercih yapıp o dönemin durum ve şartlarına göre yeni sözleşme tipleri belirlemektedir. Zamanla gelişen ve değişen sözleşme tiplerinin son formu karşımıza “kamu özel işbirliği” olarak çıkmaktadır. Doktrinde, bu yeni modelin hukuksal çerçevesinin belirlenebilmesi ve söz konusu modelin getirdiği ve götürdüklerinin tayini noktasında geniş tartışmalar yapıldığı görülmektedir. Bu tartışmaları incelemek, irdelemek, çözüm bulabilmek açısından bir katkıda bulunabilmek noktasında bu çalışma kaleme alınmıştır. | en_US |
| dc.description.abstract | In terms of hiring private legal entities for classical public service, the government makes choices depending on the period and determines new contract types based on the terms and conditions of that period. These contract types developing and changing in time reveals itself as “public private sector cooperation”. In doctrine, it is seen that there are disagreements on the advantages and disadvantages of this new model as well as on determining its legal framework. This study focuses on studying these disagreements, analyzing them and thus it offers a contribution in terms of providing a solution. | en_US |
