| dc.description.abstract | Tez çalışmamızda, Türk Ceza Kanunu'nda düzenlenen uyuşturucu veya uyarıcı madde imal ve ticareti suçu (TCK m.188) incelenmiştir. Uyuşturucu veya uyarıcı maddelerin kullanımı, eski zamanlardan günümüze kadar devam etmiştir. Bu maddelerin kullanımı zamanla kişilerin fiziksel ve psikolojik sağlığı üzerinde olumsuzluklara yol açmıştır. Ayrıca toplumlar ve devletler de bu olumsuzluklardan etkilenmişlerdir. Kullanımın artması, uyuşturucu veya uyarıcı madde imal ve ticaretinin yasal olmayan yollardan yapılmasını yaygınlaştırmıştır. Bu nedenle devletler, ulusal ve uluslararası ölçekte mücadele anlamında faaliyet göstermişlerdir. Bu kapsamda çalışmamızın ilk bölümünde, uyuşturucu veya uyarıcı madde kavramı, tanımı, çeşitleri incelenmiş, buna ilişkin uluslararası sözleşmeler, örgütler ve hukukumuzda yer alan düzenlemeler ile mukayeseli hukukta uyuşturucu veya uyarıcı maddelerle ilgili düzenlemeler incelenmiştir. İkinci bölümde uyuşturucu veya uyarıcı madde imal ve ticareti suçunun koruduğu hukuki yarar, suçun unsurları, kusurluluk ve nitelikli halleri ele alınmıştır. Üçüncü bölümde ise, suçun özel görünüş biçimleri, yaptırım, etkin pişmanlık, zamanaşımı, soruşturma ve kovuşturma konuları incelenmiştir. Sonuç kısmında ise, çalışmamızda yer alan konulara ilişkin değerlendirmelerimize yer verilmiştir. | en_US |
| dc.description.abstract | Within the scope of our thesis study, the crime of manufacturing or trafficking drugs or stimulants regulated in the Turkish Penal Code (TCK art. 188) is investigated. The use of drugs or stimulants has continued from ancient times to the present day. The use of these substances has led to negative effects on the physical and psychological health of individuals over time. Societies and states were also affected by these negativities. The increase in the usagehas led people to chıose illegal ways of drugs and stimulants to produce and distribute. For this reason, goverment have operated struggled nationally and internationally. In this context, in the first part of our study, the concept, definition and types of drugs or stimulants have been examined, international conventions, organizations and regulations and drugs and stimulants in international law Regulations on substances in our domestic law have been included. In the second part, within the scope of the crime of manufacturing and trafficking drugs or stimulants, legal interest related with narcotic crimes, crime factors, crime and type relation, justification elements. In the third part, the specific appearance of crime, sanction, effective regret, timeout, investigation and prosecution are examined. In the conclusion part, our evaluations about the subjects in our study are included. | en_US |
