| dc.description.abstract | Tezimizin konusu güncel olması ve sosyal boyutlarıyla toplumun tamamını ilgilendiren ve hukuk devleti açısından da önemi dikkate alınarak belirlenmiştir. Tezimizin ana fikri, modern hayatta düşünce özgürlüğü ve düşüncenin topluma en kolay ve iyi şekilde sunulma yolu olan basın ve basın özgürlüğünün bir sınırı olmalıdır, bu sınırlardan en önemlisi ise özel hayattır şeklinde ifade edilebilir. Çalışmamızda öncelikle düşünce, düşünce özgürlüğü, basın, basılmış eser ve eser sahibi ile eser sahibinin sorumluluğu incelenmiştir. Daha sonra düşünce ve basın özgürlüğü ile bir anlamda zıt korelasyon ilişkisi bulunan özel hayat kavramı ve özel hayatın gizliliği ele alınmıştır. Yine tezimizde özel hayatın sınırları göreceli olarak belirlenmeye çalışılmıştır. Basın özgürlüğü, basının özel hayata müdahalesi, basının haber yapma sınırları değerlendirilmiş ve özel hayatın Türk hukukunda anayasal ve yasal düzeyde ne derece koruma altına alındığı mevzuat çerçevesinde incelenmiş, ayrıca uluslar arası düzenlemelere de kısaca değinilmiştir ve bu düzenlemelerin yeterliliği değerlendirilmiştir. Hukuki sorumluluk kısaca incelendikten sonra cezai sorumluluk ayrıntılı incelenip basın kanunu ve Türk Ceza Kanunu kapsamında sorumlu kişinin kim olduğu hususu ayrıntılı anlatılmıştır. Son bölümde ise Türk hukukunda özel hayatın gizliliğine karşı basın yoluyla işlenen suçların soruşturma ve kovuşturma usulüne değinilmiş özellikle iddianamenin düzenlenmesi, görevli ve yetkili mahkeme ile şikayete tabi suçlarda şikayet şartı ayrıntılı olarak incelenmiştir. Bir bütün olarak bu çalışmamızda; düşünce özgürlüğü ve basın özgürlüğünün sınırları, bu sınırlardan en önemlilerinden birisi olan kişilerin özel hayatları ele alınmış ve basın özgürlüğü ile özel hayat arasındaki denge noktası, sınırlarının ne olması gerektiği hususları tartışılmıştır. | en_US |
| dc.description.abstract | The topic of our dissertation is designated as it is up-to-date and also relevant to the rest of the society by social aspects and also its importance for the state of law. The main idea of our dissertation is, as one of the easiest way of deploying freedom of thought and press have to be in borders in modern life and the most important of these borders is private life. In our study, initially thought, freedom of thought, press, published material and the owner of the material and the responsibilities of the owner are investigated. Later on, as it is somehow correlated negatively with freedom of thought and press, the concept of private life and the secrecy of private life are examined. The freedom of press, the impact of press on private life, the borders of press on affirmation are evaluated and in what aspects the private life is under protection of law in the Turkish legislation context, also the international regulations are observed and the affectieness of these regulations are evaluated. After briefly considering the judicial responsibility the penal responsibilities are examined in detail and the responsible person is identified in both law of press and law of Turkish Penal Code. In the last part the way that Turkish Law deals with the intrusion of private life by using the press and especially on the preparation of the indictment, the condition of claim in crimes that are bound to appeal to a special court are observed in detail. As a whole in our this study, the borders of freedom of thought and the freedom of press, as one of the most important of these borders private lives of individuals and the equilibrium between the freedom of press and private life, the subject of matters on what should be the borders between these two are discussed. | en_US |
