dc.description.abstractTıp hukuku; "disiplinler arası" bir yapıya sahip olması sebebiyle birçok hukuk dalını da kendi içinde barındırmaktadır. Bu sebepten hastalar ile hekimler arasındaki ilişki hukuki anlamda önem arz etmektedir. Hastalar ve hekimler arasındaki ilişki; eskiden tamamen "güven ilişkisine" dayanmaktayken son yıllarda güven ilişkisinin yanı sıra sözleşmenin tarafları olmuşlardır. Hekim ile hasta arasındaki hukuki ilişki, Borçlar Hukuku çerçevesinde, istisnalar haricinde, vekalet sözleşmesi hükümlerine tabi olmaktadır. Sözleşmesel ilişki olmasının doğal sonucu olarak, tarafların yükümlülükleri de söz konusu olmaktadır. Çalışmamızda hekimin görevini yerine getirirken hastasına karşı olan yükümlükleri vekalet sözleşmesi kapsamı altında değerlendirilecektir. Hekimin yükümlülüklerini gereği gibi yerine getirememesi halinde karşılaşacağı yaptırımların neler olduğunu değerlendireceğiz.en_US
dc.description.abstractMedical law; As it has an "interdisciplinary" structure, it also includes many branches of law. For this reason, the relationship between patients and doctors is of legal importance. While the relation between a patient and a doctor was based on "trust relationship " in the past, in recent years it changed into a contract also based on trust relationship and they have become the parties of it. The legal relationship between the doctor and the patient is subject of the power of provisional contract, except for exceptions, within the framework of the Law of Obligations. As a natural result of the contractual relationship, the obligations of the parties are also in question. In our study, the obligations of the doctor to the patient while performing his duty will be evaluated under the scope of the power of provisional contract. We will evaluate the sanctions that the doctor will face in case he fails to fulfill his obligations duly.en_US
