dc.description.abstractHâkimlik bütün hukuk sistemlerinde önemli ve dikkate değer bir yere sahiptir. İnsanların tarihin başlangıcından beri yaşadıkları ortak kültürün bir parçası da uyuşmazlıklardır. Dolayısıyla insanlık bu uyuşmazlıkları çözecek hâkimlere ihtiyaç duymuştur. Bizim tezimizde ise tarihin akışı içinde ve özellikle de İslam ve Osmanlı Hukuku çerçevesinde hâkimlerin gelişimleri ve bu gelişim içinde hâkim olmak için aranan niteliklerin değişimi izlenecektir. İslam hukukunda ilk hâkim Hz. Muhammed'dir. İslam ve Osmanlı hukukunda hâkimlerde olması istenen niteliklere bakıldığında ise Hz. Peygamber bu konuda müelliflere örnek olmuştur. İslam hukukuna göre iyi bir hâkimde bulunması gereken nitelikler, Hz. Peygamber'de bulunan niteliklerdir. Kuşkusuz hiçbir kimsenin Hz. Peygamber'in bütün niteliklerine sahip olması düşünülemez. Fakat hâkimler veya hâkim olmayı düşünenler Hz. Peygamber'in bu niteliklerini öğrenmeli ve hâkimlik yaparken de bu davranışları örnek almalıdırlar. Hâkimlerde bulunması gereken nitelikler bakımından İslam hukukunda müellifler arasında bazı farklılıklara rastlanmaktadır. Bu durum oldukça normaldir. İslam hukukundaki dört temel mezhep hâkimlerde bulunması gereken nitelikler açısından birbirinden farklı içtihatlara sahiptirler. Osmanlı hukukundaki uygulamaya bakarsak, bahsedilen dört mezhepten Hanefi okulunun görüşlerini benimseyen Osmanlı devleti de bu okulun görüşlerine bağlı kalmış ve Hanefi mezhebi bakımından hâkimlerde aranan nitelikleri benimsemiş ve hâkimlerin atanmasında da bu görüşlere uymuştur.en_US
dc.description.abstractJudgeship have a significant and important place in all the legal systems. Conflicts are the part of the common culture which people has been lived since the beginning of History. Thus, humanity needed judges who could solve that conflicts. In our thesis, it will be watched that development of judges and change of the qualities wanted for becoming a judge within the framework of especially İslamic and Ottoman law. First judge in İslamic law is Prophet Mohammed. When we look at the Qualities wanted in judges in İslamic and ottoman law, prophet Mohammed is an example for the authors. For İslamic law, the Qualities needed in a good judge, is the same Qualities which Prophet Mohammed already had. Certanly, it is unthinkable no one could have all the Qualities Prophet Mohammed had. But, judges and people that want to be a judge should learn the Qualities of Prophet Mohammed and should take example behaviors of Prophet Mohammed. There is some differences between thinkers about the Qualities that judges have to have in İslamic law. This situation is quite normal. There is different thougts about Qualities to be found in judges in four main sects in İslamic law. If we look at practice in Ottoman law, Ottomans adopts the opinios of Hanafi school about qualities to be found in judges. And they abide by these thougts in appointment of judges.en_US
