Abstract
Kadılık kurumu, ilk defa Hz. Ömer zamanında kurulmuştur. Sonraki bütün İslam devletlerinde de varlığını korumuştur. Osmanlı devletinde gerek mevleviyet, gerek kaza kadılığı derece-sinde olsun kadı atamaları, Anadolu ve Rumeli kazaskeri tarafından yapılır. Merkezî yönetime bağlı olarak kazalarda görev yapan ve taşrada devletin en yetkili görevlisi konumunda olan Osmanlı kadısı, bulunduğu kazanın hem mülkî âmiri, hem hâkimi, hem belediye başkanı, hem noteri, hem askerî temsilcisi ve hem de müfettişi konumundadır. Onun kadar geniş görev alanına sahip olan bir başka memur yoktur. Kadıların görevlerine paralel olarak tutmuş oldukları ve Sicillât-ı Şer‘iye, Mahkeme Defterleri veya Kadı Defterleri gibi değişik isimlerle anılan defterlerde de muhteva itibariyle oldukça değişik türde kayıtları bulmak mümkün olabilmektedir. Fakat bu belgelerden hiçbirisi doğrudan kadının kendisi ile veya hissiyatıyla ilgili değildir. Bu çalışmada, kadıların bu yönüne ışık tutabilecek bir kadı şiiri ele alınacaktır. İsminin Osman b. Mustafa olduğunu öğrendiğimiz kadı, 1170/1756 yılı içerisinde Larende’ye kadı olarak atanmış ve 16 ay görev yaptıktan sonra ma’zûl olmuştur. Şiirini de ma’zûl olduktan sonra yazmış ve 287 numaralı Lârende Şer‘iye Sicili’ne kaydetmiştir.
The kadi institution was first launched and devel- oped by Omar, the Caliph. The institution of Calipship had been part of life in all the Muslim states. In the Ottoman state the kadi appointments on both the mevleviyet and the kaza level had been done by the kazasker of Anatolia and the Rumelia. The Ottoman kadi, who had always been a part to the central administration had a very hard duty that is to indicate that the judicial- administrative of districts and who had been the state official with the most authority in the provinces; had also been the administrator as well as the judge, the mayor, the notary public, the military representative, and the inspector of his district. There had been no official in the state who had that much responsibility on his shoulders. The Kadis had kept all the records in specific books by the name of er’iye Registers, Court Regis- ters or Kadi Registers. Every detail of the period of the Kadi had been re- ported in the book and they are today used as reference books in every matter. But none of those records had been related to the Kadi himself or to his feelings. In this study, a kadi’s poem throwing light on the personal side of the kadis will be examined. The kadi known as Osman b. Mustafa was appointed as kadi to Larende in the year 1170/1756 and dismissed after serving for 16 months. He wrote his poem after his dismissal and record- ed it in the Larende Şer’iye Register number 287.
