dc.description.abstractUZAKTAN ÇALIŞMADA İŞVERENİN İŞ SAĞLIĞI VE GÜVENLİĞİNE İLİŞKİN YÜKÜMLÜLÜKLERİ Uzaktan çalışma, işçi işveren tarafından belirlenen çalışmaları evinde veya işyerinden ayrı bir yerde teknolojik iletişim aletleriyle yerine getirmesi için kurulan iş ilişkisidir. Teknolojinin ve iletişimin ilerlemesiyle günümüzde uzaktan çalışma hayatındaki işçilerin sayısı artmaktadır. Bu sayının artmasıyla birlikte çalışma hayatın doğrudan ya da dolaylı olarak birçok konuda etkilemektedir. Uzaktan çalışmada iş sağlığı ve güvenliğinin sağlanması için işverenin yerine getirmesi gereken birçok yükümlülüğü vardır. İşveren iş sağlığı ve güvenliği için gerekli olan bu tedbirlerin alınmasının yanında alınan tedbirlerin uygulanmasının denetlenmesi iş sağlığı ve güvenliği için büyük önem arz etmektedir. Uzaktan çalışanın alınan bu tedbirlere uymakla yükümlüdür. Uzaktan çalışmada işverenin iş sağlığı ve güvenliğine ilişkin yükümlülükleri konulu bu tez çalışmasında ilk olarak uzaktan çalışma ile ilgili bilgilere yer verilere yer verilecektir. Çalışmanın ikinci bölümünde uzaktan çalışmada işverenin ve uzaktan çalışanın iş sağlığı ve güvenliğine ilişkin yükümlülüklerinin neler olduğunun belirlenmiştir. Belirlenen bu yükümlülükleri nasıl yerine getirmesi gerektiği ve bu süreçte uygulamada karşılaşılacak problemlerin neler olduğu tespit edilmiştir. Çalışmanın son bölümünde ise karşılaşılan problemlere mevzuatımızda düzenlenen kurallar, uluslararası sözleşmeler ve doktrin çerçevesinde alternatif çözüm yollarını incelenmiştir.en_US
dc.description.abstractOCUPATİONAL HEALTH AND SAFETY OBLIGATIONS OF THE EMPLOYER IN REMOTE WORKING Teleworking is a labour relationship established for the employee to perform the work determined by the employer at home or in a place separate from the workplace with technological communication devices. With the advancement of technology and communication, the number of workers in remote working life is increasing. With the increase in this number, it affects working life directly or indirectly in many issues. The employer has many obligations to fulfil in order to ensure occupational health and safety in remote working. In addition to taking these measures necessary for occupational health and safety, the supervision of the implementation of the measures taken is of great importance for occupational health and safety. The remote worker is obliged to comply with these measures. In this thesis on the obligations of the employer regarding occupational health and safety in remote working, firstly, information about remote working will be given. In the second part of the study, it is determined what are the obligations of the employer and the remote worker regarding occupational health and safety in remote working. It has been determined how these obligations should be fulfilled and what are the problems to be encountered in practice in this process. In the last part of the study, alternative solutions to the problems encountered are examined within the framework of the rules regulated in our legislation, international conventions and doctrine.en_US
