Özet
Modern uluslararası ilişkiler disiplininin doğuşu ile birlikte gündeme gelen modern egemenlik anlayışı devletlere mutlak bir güç vaat etmiştir. Egemenlik sınırlarını korumak isteyen ve güç arayışında bulunan devletler için ise güvenlik oldukça önemli bir yere sahiptir ve devletler, kendi güvenliklerini riske atacak bir düzen içerisinde, egemenlik gibi kutsal gördükleri ilkeye sahip çıkarak sınırlarını korumaya çalışmaktadırlar. Güvenliği, uluslararası barış ve istikrar ortamını sağlamak için oluşturulan genelinde üst otoriter uluslararası hukuk ve özelinde küresel örgütler, devletlerin kurduğu bu düzen yönünde çelişkiler oluşturmaktadır. Güvenlik gibi önemli bir ihtiyacı karşılayan uluslararası hukuk aynı zamanda egemenlik üzerinde tehdit oluşturan bir unsur olarak bilinmektedir. Devletlerarası ilişkileri düzenleyen ve denetleyen bir yapı olan uluslararası hukukta insani müdahale nosyonu hem güvenlik hem egemenlik çelişkisi arasında kalmış ve disipliner açıdan büyük bir tartışma konusu haline gelmiştir. Bu çalışma uluslararası hukukta insani müdahale ilkelerinin hem uluslararası ilişkiler disiplininde ki teorilerde nasıl yer aldığını hem de pratiğinde nasıl uygulandığını kapsamaktadır. Çalışmanın temelinde uluslararası örgütlerin çıkarlardan arınarak etik değerler ve gerçekçi insani amaçlar ile uygulanan bir müdahalecilik geliştirememesi irdelenmiştir ve uluslararası ilişkiler disiplininde ileri sürülen ana savların pratikte uygulamalara nasıl etki ettiği tartışılmıştır.
The understanding of modern sovereignty that emerged with the emergence of the discipline of modern international relations has promised the states absolute power. For the states that want to protect the borders of sovereignty and seek power, security has a very important place and states, in a system that will jeopard their own security, try to protect their borders by protecting the principle that they consider sacred as sovereignty. In order to ensure security, international peace and stability environment, high authoritarian international law in general and global organizations in particular, create contradictions towards this order established by states. International law, which meets an important need such as security, is also known as a threat to sovereignty. The notion of humanitarian intervention in international law, which is a structure that regulates and controls interstate relations, has been between the security and sovereignty contradictions and has become a subject of disciplinary debate. This study covers how the principles of humanitarian intervention in international law take place both in theories of international relations discipline and how they are applied in practice. At the basis of this study, it is scrutinized that international organizations cannot develop an interventionism which is applied with ethical values and realistic humanitarian aims by purifying the interests and it is argued that how the main arguments put forward in the discipline of international relations affect the executions in practice.
