Özet
Küresellesme, gün geçtikçe artan uluslararası rekabet ve teknolojideki hızlı gelismeler, hayatın diger alanlarında oldugu gibi çalısma hayatında da bir takım yenilikleri ve degisiklikleri beraberinde getirmistir. Küresellesme, uluslar arası rekabet ve yeni teknolojik gelismeler, isgücüne gereksinimi azaltmıs ayrıca isverenler ve isçiler arasında normal tipteki is iliskilerinden farklı esneklik temeline dayanan yeni tipte is iliskileri ortaya çıkmıstır. Esneklik temeline dayanarak ortaya çıkan yeni tipteki is iliskilerinden bir tanesi de ödünç is iliskisidir. Ödünç is iliskisi; bir isverenin kendisine hizmet sözlesmesiyle baglı isçisini, onun da rızasını almak kosuluyla belirli ve geçici bir süreligine is görme edimini yerine getirmek üzere baska bir isverenin emrine vermesiyle olusan is iliskisidir. Bu tezde 4857 sayılı is Kanunu hükümleri çerçevesinde ?Ödünç iş iliskisi? kavramı ele alınacak ve bu iliskinin kurulması, hüküm ve sonuçlarıyla birlikte açıklanacaktır.
Globalization, in the course of time increasing international competition and quick development in technology have brought to light some reform and variation in working life like other areas of life. Globalization, international competition and new technologic development have reduced necessity of labour, furthermore new type business relationships ,which are based on flexibility basic, and different from normal type business relationships have appeared between employer and employee. One of the new type business relationships which are based on flexibility basic is temporary agency work. When an employer takes his employer permission and gives his employee, who is dependent on him with a work aggreement, to another employer for a temporary period, temporary agency work is in question. In this thesis, the concept of ?temporary agency work?, its foundation and consequences will be examined within the framework of the Law on Labor 4857.
