Abstract
Deniz kirliliği dendiğinde belki de ilk önce akla gelen kirlilik türü gemilerden kaynaklı kirlenme olmaktadır. Gemilerden kaynaklı kirlilik, deniz kirliliğinde oldukça önemli bir rol oynasa da deniz yatağı faaliyetlerinden kaynaklanan kirlilik de çok bilinmeyen veya geri planda görülen deniz kirliliğinin bir başka kaynağını oluşturmaktadır. Enerji kaynaklarına yönelik artan küresel talep ve teknolojideki önemli gelişmeler petrol ve gaz endüstrisine olan ilginin ve talebin de artmasına neden olmuştur. Bu durum petrol ve gaz faaliyetlerinin karadan, denizlere doğru kaymasına neden olmuştur. Bugün, kıyı ötesi üretim, dünyadaki petrol ve doğal gaz talebinin ve tedarikinin ayrılmaz bir parçası, önemli bir bileşenidir. Dolayısıyla kıyı ötesi petrol ve gaz faaliyetlerinin sürekli büyümesi ve artması, deniz ekosistemleri ve biyolojik kaynaklar üzerindeki etkisi de dâhil olmak üzere birçok önemli soruyu gündeme getirmiştir. Çalışmamızda öncelikle kıyı ötesi petrol ve gaz faaliyetlerinden ne anlaşılması gerektiği hususu üzerinde durulacaktır. Daha sonra kıyı ötesi petrol platformlarına ve bu platformların hukuki niteliğinin ne olduğu konusuna değinilecektir. Son olarak kıyı ötesi petrol ve gaz faaliyetlerinin deniz çevresine etkisinden bahsedilecektir. Bu bağlamda kıyı ötesi petrol ve gaz faaliyetleri esnasında meydana gelen kirlilik ve kıyı ötesi petrol ve gaz faaliyetlerinde kaza sonucu ortaya çıkan kirlilik konuları incelenecektir.
The very first type of pollution that comes to mind is the ship-source marine pollution, when the topic is about marine pollution in general. Despite the highlighted notoriety of the mentioned type of pollution, there is another alarmingly impactful type of pollution, which is rather neglected; pollution stemming from seabed activities. In the wake of pressing global demand for energy resources as well as of the important technological developments, there has been an increase in the attention attached to the matters of petroleum and gas industry, which in turn caused a massive redeployment of industry-related activities hitherto operated on land into the sea. Today, offshore activities in the sector are an important ingredient of the whole demand and supply system of petroleum and natural gas. This increase in the volume of the sector calls for a closer scrutiny of many problems including but not limited to the impact of these activities on marine ecosystems and biological resources. In this paper, we aim first to elaborate the meaning of off-shore petroleum and gas activities. Following that, the question of petrol platforms and the legal status of petrol platforms will be probed into. Finally, the paper will try to shed some light on the impact of off-shore drilling activities on the marine environment. Within the purview of this last undertaking, special attention will be given to firstly to that type of pollution emanating from off-shore drilling activities as well as to that which occurs as a result of accidents.
