Türk Silahlı Kuvvetlerine mensup bir grup subayın liderliğinde 27 Mayıs 1960
tarihinde yapılan darbe sonucunda Demokrat Parti hükümeti iktidardan uzaklaştırılmıştır. Darbe sonrasında oluşan askeri rejimin temel amaçlarından birisi de yeni bir
anayasa yapmak olmuştur. Bu amacın neticesi olan 1961 Anayasası, askeri bir rejim
sürecinde hazırlanıp yürürlüğe konulmuş ve bu nedenle çok partili siyasi rejimde öne
çıkan sorunlar anayasanın şekillenmesinde büyük ölçüde etkili olmuştur. Kısacası,
1961 Anayasasının Türkiye Cumhuriyetinin ilk çok partili siyasi hayat deneyimine
tepki niteliğinde bir anayasa olduğunu söyleyebilmek mümkündür. Anayasanın bu
özelliği nedeniyle 1924 Anayasası dönemine bir tepki olarak, 1961 Anayasasında çoğulculuğu güvence altına almaya yönelik birçok unsur bulunmaktadır. Ancak, söz konusu çoğulcu unsurların yanısıra demokrasi ile bağdaşması pek mümkün görünmeyen
ve vesayetçi olarak nitelenebilecek unsurlar da anayasada yer almaktadır. Bu çalışmada 1961 Anayasası, içermiş olduğu çoğulcu ve vesayetçi unsurlar yönüyle incelenmeye çalışılmıştır.
As a result of the coup carried out on 27 May 1960 under the leadership of a group of officers from Turkish Armed Forces, Democrat Party government was removed from power. One of the main aims of the military regime formed after the coup was to make a new constitution. 1961 Constitution, which was the result of this aim, was prepared and put into effect during a military regime, and for this reason, the prominent problems in the multi-party political regime were largely influential in the shaping of the constitution. In short, it is possible to say that 1961 Constitution was a reaction to the first multi-party political experience of the Republic of Turkey. Due to this feature of the constitution, there are many elements to ensure pluralism in 1961 Constitution as a reaction to 1924 Constitutional period. However, in addition to the aforementioned pluralist elements in the constitution, there are also elements that seem unlikely to be compatible with democracy and can be described as tutelary. In this study, 1961 Constitution was tried to be examined in terms of its pluralist and tutelary elements.
