Özet
Çalışma konumuz 5510 sayılı Kanuna göre kamu görevlilerinin maluliyetidir. Konu 3 bölüme ayrılarak incelenmiştir. Birinci bölümde genel bilgiler başlığı altında kamu idareleri, kamu görevlisi, kamu hizmeti, kamu yararı, malullük kavramları açıklanmıştır. Ayrıca bu Kanunun 4/c kapsamındaki sigortalılara da yer verilmiştir.
Kamu görevlisi, kamu kesiminde bir teşkilata bağlı olarak görev yapar ve kamu
hizmeti ifa eden kişilerdir.
İkinci bölümde, malullük türleri başlığı altında adi malullük, vazife ve harp
malullüğü incelenmiştir. Bu konular incelenirken, herbir malullük türü açısından bu
malullüklerin oluşabilmesi için gerekli olan şartlar sayılmıştır. Bir kamu görevlisinin
adi malul sayılabilmesi için iki durumdan birinin gerçekleşmesi şarttır. Birinci durum
çalışma gücü kaybının en %60 olmasıdır. İkinci durum ise vazifesini yapamayacak
şekilde meslekte kazanma gücünü kaybetmesidir. Adi maluliyet halinin Kanun’un
beyan ettiği şartlar dâhilinde meydana gelmesi halinde de vazife malullüğü oluşur.
Yine vazife malullüğünün Kanun’da beyan edilen kişilerce ve beyan edilen yerlerde
meydana gelmesi durumunda da harp malullüğü oluşur. Bu konular açıklanırken
Danıştay, Yargıtay ve Askeri Yüksek İdare Mahkemesi kararlarına sıklıkla yer
verilmiştir. Böylece konuların daha net anlaşılmasının sağlanması amaçlanmıştır.
Son bölümde ise malullüğün sonuçları başlığı altında, en önemli sonuç olan
malullük aylığı konusuna değinilmiştir. Her malullük türü açısından aylık alma
şartları, hesaplanması, başlaması, ödenmesi, kesilmesi gibi konular açıklanmıştır.
Ayrıca malulen emekli olanların sağlık hizmetlerinin karşılandığı genel sağlık
sigortası konusuna da temas edilmiştir. Sonuç kısmında da konuya ilişkin tavsiye ve
görüşler, Kanunun düzenlenmesinde yapılan yanlışlar değerlendirilmiştir. Bu şekilde
konuya son verilmiştir.
In this discourse we analyzed the government official?s disability according to the 5510 Numbered Code. The aspect is divided to 3 parts. In the first part, the terms of public administration, government official, public service, public benefit and disability were analyzed in the light of general information. In addition, the covered employee's, who are regulated in the same litigation's rule 4/c, was also mentioned. Government official is someone who works in a government organization and performs public service. In the second division, under the title of disability; petty disablement, duty disablement and war disablement were analyzed. While these terms were discussed, legal requirements of every separate kind of disability were counted. To be considered a government official as a petty disable, one of these requirements should be occurred: First, lack of the working ability must be at least 60 percent. Second, as a result of losing the earning ability in an occupation, the occupation can not be performed in the proper way. If a petty disable also has some particular requirements which are written in the Code, he or she is called as a duty disable. Eventually, if the duty disablement appears to the particular people and in the particular places, which are written in the Code, this situation is called war disablement. While these aspects were explained legal precedents of Turkish Supreme Court of Appeals, Council of State, Martial Supreme Administrative Court are examined. Thus, to be understood the topics more clearly is targeted. Eventually disablement pension is mentioned in the last division, under the title of the results of disablement. The conditions of to qualify for a disablement pension, calculating the amount of a pension, to start getting a pension, to pay, and to be cut of a pension etc. were explained. Moreover, the general health insurance which is used for in order to supply health service to physically disabled pensioners was also mentioned. In the division of conclusion, the suggestions and opinions related to the topic, errors in the regulation of the Code were considered.
