Özet
Mesleğini ortaklık kurarak yürütebilmek bir avukat için de temel bir insan hakkı sayılmalıdır. Usul hukukunun amaçlarını olumlu etkileyen bu hakkın kullanılması için hukuk düzeni olanak sağlamalıdır. Tüzel kişilik şeklinde ?Avukatlık Ortaklığı? Türk Hukukuna, Avukatlık Kanununda 2001 yılında 4667 Sayılı Kanunla yapılan değişiklikle girmiştir. Bu düzenlemeyle getirilen ve daha çok şahıs şirketine benzeyen, kendine özgü ortaklık tipine uygun olarak, az sayıda avukatlık ortaklığı kurulmuştur. Gerek ABD'nde, gerekse AB ülkelerinde avukatlar, sermaye şirketi şeklinde şirketleşebilmektedir. Sermaye şirketi şeklinde kurumsallaşmanın ise, daha çok rekabet edebilme olanağı sağladığı görülmektedir. Avrupa avukatlık meslek kuralları, ABD avukatlık kuralları karşısında değişime uğramaktadır. Günün değişen koşulları karşısında Türk avukatlık meslek kurallarında değişiklik ihtiyacı kendisini yoğun bir şekilde hissettirmektedir. Avukatlar avukatlığın amacı ve niteliklerine uygun olarak sermaye şirketi şeklinde avukatlık ortaklığı kurabilmelidir. ?AB ve Türk Hukukunda Avukatlık Ortaklığı? konulu doktora tezimizde, ?Avukatlık Ortaklığı?, AB Hukuku ve AB üyesi ülkelerin uygulamalarıyla karşılaştırmalar yapılarak incelenmiş, konuyla ilgili alternatif öneriler geliştirilmeye çalışılmıştır.
Being able to carry on his occupation by forming a partnership should be considered a basic human right for a lawyer. Legal system should make the usage of this right possible, which has a positive impact on the aims of procedural law. ?Lawyers? Partnership? in the form of a legal entity was introduced in Turkish law with the amendment brought by the Law Number 4667 in the Attorneyship Act in 2001. Few law firms which were introduced by this regulation and resembles mostly a partnership company were established in accordance with partnership type which peculiar to its own. In the world, the US lawyers and the lawyers from member states of the European Union compete with each other. Lawyers both in the U.S. and in the EU member states can form corporations having the form of business partnerships. It has been observed that such institutionalization provides a competitive advantage. European codes of conduct are continuously changing in parallel with those of the U.S. Bearing in mind the fact of ever-changing circumstances of the life, the need for change in Turkish attorneyship legislation is deeply felt. Lawyers, in accordance with the ?raison d?être? of the profession and the qualifications needed thereof, should be able to form business partnerships. In my doctoral dissertation titled ?Lawyers? partnership in the EU and Turkish Law?, I tried to come up with alternative proposals about the subject by analysing ?Lawyers? Partnership? and comparing it with not only the EU Law, but also the national applications in the EU member states.
