Özet
Bu tez çalışmamızda günümüz Türk hukukuyla karşılaştırmalı olarak İslam hukukunda özel hayatın korunmasını inceledik. Özel hayatın korunması insan hakları içinde son derece büyük öneme sahiptir. İslam hukukunun temel kaynakları olan Kuran ve sünnet özel hayatın korunması noktasında çok sayıda düzenleme içermektedir. Örnek olarak burada Kuran'dan şu ayeti aktarabiliriz : ?Ey iman edenler! Zannın çoğundan kaçının. Çünkü zannın bir kısmı günahtır. Birbirinizin kusurunu araştırmayın. Biriniz diğerinizi arkasından çekiştirmesin?? (Hucurat, 49/12) 10 Aralık 1948 tarihli İnsan Hakları Evrensel Bildirisinde vurgulanan özel hayatın korunması Türk Anayasalarında ise tam olarak 1961 Anayasasında düzenlenmiştir. Özel hayatın korunması ahlak hukuk ilişkisi açısından da son derece önemlidir. Karşı karşıya kaldığımız pek çok problem ahlaki değerlerin desteği olmaksızın sadece hukuk yoluyla çözülemez. Özellikle özel hayatın korunması noktasında ahlaki değerler çok önemli bir unsurdur. Kanaatimizce ahlaki ve hukuki değerler aslında gerçekliğin birbirini tamamlayan iki görünümüdür ve ideal bir toplum her iki unsurun uyumlu birlikteliğinden oluşur.
In this thesis we investigated ?Protection of Privacy Life? in İslamic law comparatively with Turkish law. The protection of privacy life has got importance in human rights. The Quran and Sunnah that they are basic origin of İslamic Law include a lot of principle for protection of privacy life. For example we can quote this verse from Quran: ?O ye who believe! Avoid suspicion as much (as possible); for suspicion in some cases is a sin. And spy not on each other, nor speak ill of each other behind their backs...? (al-Hujurat; 49/ 12) Right of privacy life is emphasized in ?The Universial Declaration of Human Rights? (10 December 1948) and this right is completely arranged in 1961 Constitution in Turkey. The protection of privacy life very importing subject from the standpoint of relation between ethic and law. The problems that we are meeting with them face to face cannot be solve by the juridical channels without aid of moral values. Especially, moral values are very importing component in protection of privacy life. We believe in the fact that moral values and laws are two aspects of reality which complete each other and the ideal society exists with the union of both.
