| dc.description.abstract | Borcun taksitle ödenmesi prosedürü, cebrî icra vasıtasıyla malları haczedilen borçlunun, mallarının satılmasını önlemek için başvurabileceği bir yoldur. Borçlu mallarının haczedilmesinden sonra ancak alacaklının satış talebinden önce borcun taksitle ödenmesi taahhüdünde bulunarak icra takibini durdurabilir ve satışı önleyebilir. Borçlunun borcunu icra hukuku kapsamında taksitlendirebilmesi için kanunda belirtilen şartları yerine getirmesi ve bu taahhüdü icra dairesinde yapması gerekir. Borcun taksitlendirilmesi 2 farklı şekilde yapılır. İlki borçlunun tek taraflı olarak yaptığı ve alacaklının muvafakatına gerek olmayan taksitle ödeme taahhüdüdür. Hacizden sonra satış talebinden önce yapılması gereken bu taahhüt, ilk taksit hemen verilmek üzere borcun en çok 4 taksitte ödeneceği ve her bir taksitin borcun 4'te 1'i oranında olması koşulunu taşımalıdır. Borcun taksitlendirilmesinin diğer yolu taksitle ödeme sözleşmesidir. Bu sözleşme hem hacizden önce hem de hacizden sonra yapılabilmekte olup, toplam sürenin 10 yılı geçmemesi koşuluyla şartları taraflarca serbestçe belirlenebilir. Taksitle ödeme taahhüdünün veya sözleşmesinin şartlarını makul bir sebep olmaksızın yerine getirmeyen borçlu 3 aylık tazyik hapsiyle cezalandırılır. Alacaklının şikayeti üzerine tazyik hapsiyle cezalandırılan borçlu, borcunu ödediği takdirde ceza ortadan kalkar ve derhal tahliye edilir. | en_US |
| dc.description.abstract | The procedure of payment of the debt in installments is a way that the debtor whose property is distrained through enforcement can prevent the selling of his property. The debtor can discontinue the execution proceeding and prevent the sale by undertaking to pay his debt in installments after attachment of properties and before sales demand. To pay in installments according with enforcement law, the deptor has to fulfill the requirements regulated by law and make this undertaking offer in the execution office.. The installment of the debt is made in 2 different ways. The first one is the commitment to pay in installments unilaterally by debtor and without the creditor's approvel. According to this commitment which must be made before the sale request and after the attachment, the deptor should state that he or she will pay the debt in up to four equal installments and has to give first installment immediatly. The second one is to make payment contract in installment. This contract can be made both before and after attachment. The debtor and creditor can assign the terms of the installment contract freely with condition of maximum 10 years. The debtor who is not fulfilling the conditions of his commitment to the payment or the terms of contract without a reasonable cause is punished with three-months duress of imprisonment. If the debtor, who is charged with duress of imprisonment upon the complaint of the creditor, pays the debt followed by immediate release and dissapearence of charges. | en_US |
