| dc.description.abstract | Ülkemizde suça sürüklendiği gerekçesiyle soruşturulan ve kovuşturulan çocuk sayısı giderek artmaktadır. Adli istatistiklere göre, bu artış nüfus artışından daha fazladır. Suç işleme yaşı giderek düşmektedir. Kovuşturmaya muhatap olsa bile hatta infaza konu olsa bile tekerrür önlenememektedir. Çocuklar için hürriyeti bağlayıcı cezalara ancak son çare olarak başvurulabileceği malumun ilamıdır. Kamu vicdanı, mağduriyetin giderilmesi, onarıcı adalet ve ıslah birlikte tasavvur edildiği zaman; ıslahın çocuk açısından önemi diğer hususlara tercih edilmelidir. Çocukların dürüst, ahlaklı, namuslu ve toplum için faydalı –en azından zararsız- bireyler olarak yetişmesi, içerisinde bulundukları toplum, aile, ekonomik şartlar, eğitim imkânları gibi pek çok parametreye bağlıdır. Bu cümleden olarak, çocukların tedibi ve ıslahı multi-disipliner bir çalışma alanıdır. Çocukların, isnat edilen suçların mana ve mahiyetini kavrayıp kavrayamadıkları konusundaki ihtilaf, denklemi daha da zor bir hale getirmektedir. Ülkemizde çocuk yargılaması ve münhasıran çocuk infazı bu çalışmada incelenirken, suç ve cezaya kavramsal yaklaşımlar, infazın hukukumuzdaki yeri, adli istatistikler ışığında suça sürüklenen çocuk ve çocuk infazındaki başlıca sorunlar da ele alınmıştır. Adli verilerin geleceğimiz ve gençliğimiz adına iç açıcı olmadığını itiraf ederek önlem almak durumundayız. Şüphesiz, böyle sofistike bir konuda başarılı olmak, sosyal nitelikli devlet aygıtı ile sivil toplumun kolektif, müşterek çalışması ile mümkün görünmektedir. | en_US |
| dc.description.abstract | The number of children being investigated and prosecuted for delinquency has increased gradually in our country. According to the forensic statistics, this increase is much more than the increase in population. The age for juvenile delinquency has reduced gradually. Recidivism cannot be prevented even if it is being prosecuted and even executed. It is a known fact that punishments restricting freedom are fallen back on for children. Calculated with public conscience, relief, restorative justice and amendment; the importance of amendment in terms of child should be preferred to the other cases. Growing up as an honest, moral and beneficial - at least harmless- to society is related to lots of parameters, as the society and family, economic situation, educational opportuties. So, the disciplinary and amendment to children is a multi- discipliner field of study. The controversy if the children apprehend the intention and nature of the alleged crime, makes the equation harder. Besides judging children and exclusively execution of children in our country is studied in this work, conceptual approaches to crime and punishment, the place of execution in law, juvenile delinquency in the light of forensic statistics and main problems in the execution of juveniles are examined. Confessing the forensic data is not pleasant for the sake of our future and youth, we have to take precautions. Beyond any doubt, succeeding in such a sophisticated field seems possible with collective interoperability of social- qualified state instrument and civil society. | en_US |
