Özet
1982 Anayasası’nın 67. maddesi, “seçme, seçilme ve siyasi faaliyette bulunma hakları” başlığını taşımaktadır. Maddeye göre, kamu hizmeti ifa eden kamu görevlileri mahalli idare üyesi veya milletvekili olarak seçilme hakkına sahiptir. Bununla birlikte kamu görevlileri bazı şartları yerine getirmedikçe bu haktan yararlanamaz. Bu şartların başında istifa gelir. Kamu görevlilerinin seçimden önce istifa etmeleri mevzuat tarafından düzenlenmiştir. Seçimi kaybeden kamu görevlileri önceki görevlerine, önceki görevleri dolu ise durumuna uygun bir göreve döner. Bunun için kamu görevlilerinin, Yüksek Seçim Kurulunca seçim sonuçlarının ilanından sonra 1 ay içinde ayrıldıkları idareye başvurmaları gerekmektedir. Seçimle işbaşına gelen kamu görevlileri ise tekrar önceki görevlerine geri dönemezler.
Article 67 of the 1982 Constitution is entitled as “Right to Vote, to be Elected and Engage in Political Activity”. According to the article, public officers have a right to be elected as a deputy or a member of local government. However, they can not enjoy this right, unless they fulfill some conditions. The first condition is to resign from public service. The resignation of public officers before the election is regulated by law. The reason for this is to prevent them from using official power for their personal interests. After the election, the person who lost in the election should be reinstated his/her former post, if not available, another appropriate post. For reinstatement, the person has to apply to his/her former organizations in one month following the announcement of the election results by the Supreme Council of Election. Nevertheless, the public officers who were elected can not be reinstated their previous posts.
