Özet
Öz Çalışmamızın konusu; İngiliz Hukuku’nda yapı malikinin sorumluluğunun incelenmesidir. Yapı malikinin sorumluluğu, bir binanın veya diğer yapı eserinin malikinin, intifa veya oturma hakkı sahiplerinin, bina veya yapılardan ötürü üçüncü kişilerin uğradığı zarardan sorumlu tutulmalarını ifade etmektedir. İngiliz Hukuku’nda yapı malikinin sorumluluğuna ilişkin düzenlemeler, bina veya yapı eserinde izinli ve izinsiz olarak bulunan üçüncü kişiler bakımından farklılık göstermektedir. Bina veya yapıda izinli olarak bulunan üçüncü kişilere ilişkin düzenlemeler, İngiliz Hukuku’nda Occupiers’ Liability 1957 Kanun’unda yer verilmiş, izin olmadan bina veya yapıda bulunan kişilere karşı olan sorumluluk ise; Occupiers’ Liability 1984 Kanun’unda yer almaktadır. Çalışmamız bakımından yapı malikinin sorumluluğu konusuna ilişkin olarak bina veya yapı eserinde izinli olarak bulunan kişilere karşı olan sorumluluk kapsamında düzenlenen, Occupiers’ Liability 1957 Kanun’u dikkate alınacaktır.
Abstract Our study aims to consider the liability of occupiers under English Law. Occupiers can be referred to the owner of the building, as well as those who occupy the building by way of residence rights. Under English Law, occupiers can be held responsible to third parties for the damage caused by buildings or structures. The regulations regarding the responsibility of occupiers differ in terms of third parties who are present in the building or building work with permission, known as visitors and those without permission, known as trespassers. The rules relating to the responsibility of occupiers towards third parties who are in the building or structure with permission are set out in the Occupiers’ Liability Act 1957. In contrast, the liability against persons who are in a building or structure without permission are set out in the Occupiers’ Liability Act 1984. Our study will focus on the responsibility of occupiers towards visitors who are on the premises with permission, as set out in the Occupiers’ Liability Act 1957.
