Özet
Çalışmamızın ana yörüngesi Avrupa İnsan Hakları Sözleşmesi'nde din ve vicdan hürriyetidir. Bununla beraber , inanç özgürlüğü sadece Avrupa konseyine tabi üye ülkelerin sorunu değildir. İnsanlık tarihinin başlangıcından beri bütün dünyanın ortak sorunu olmuştur. Bu nedenle çalışmamızın ilk bölümünde din ve vicdan hürriyetine ilişkin yakın tarihteki hukuksal düzenlemelere de kısaca değinmeye çalıştık. İkinci bölümde Avrupa İnsan Hakları Mahkemesinde din ve vicdan özgürlüğü başlığı altında , inanç özgürlüğün içsel ve dışsal korunma alanlarına ve sözleşme organlarının bu konulara yaklaşımına değinilmiştir. Son bölümde de inanç özgürlüğünün 9. madde kapsamında sınırlandırılma usulü hakkında örnek kararlarla özet sonuçlar çıkarılmaya çalışılmıştır.
The main trajectory of our work is freedom of religion and conscience in European Convention on Human Rights. Nevertheless freedom of religion is not only a problem of the European Council member countries. This has been a common problem of all the world since the beginning of human history. Because of this reason in the first part of our study we tried to touch briefly the legal regulations concerning the recent history related to the freedom of religion and conscience. In the second part of our study in European Convention on Human Rights under the title of freedom of religion and conscience, freedom of religion to the internal and external protection areas and the approximation of convention bodies to these topics are dealt with. In the last part of our study in freedom of religion decisions are tried to be made with the examples of summary conclusions about the limits on the systematic procedures in the scope of 9th article.
