| dc.description.abstract | Markayı kullanma hakkı, kural olarak, marka sahibine aittir. Markanın bir baş- kası tarafından izinsiz kullanılması ise, marka hakkına tecavüz fiilini oluşturur. Bu- nunla birlikte lisans sözleşmesi çerçevesinde lisans alanın markayı kullanmasına izin verilebilir. Lisans alanın lisans hakkını izinsiz genişletmesi veya lisans hakkını üçün- cü kişilere devretmesi halinde ise, çeşitli hukuki ve cezai yaptırımlar ortaya çıkabilir. Bu çalışmada, lisans alanın lisans sözleşmesine (lisans sözleşmesinden kay- naklanan haklarına) aykırı davranışlarından, sadece marka lisans hakkının izinsiz ge- nişletilmesi veya üçüncü kişilere devri incelenmiştir. | en_US |
| dc.description.abstract | As a rule, the rights conferred by trade mark belongs to the proprietor. Therefore, unauthorized use of trade mark by another person shall infringe the right of the proprietor. However, use of trade mark can be tranferred to a third party by license agreement. If the duration and scope of the license agreement is altered by the licensee or the licensee transfer his right to a third party without permission, proprietor may invoke rights conferred by trade mark against him. In this study, only these two infringements of lisencee is examined. | en_US |
