Özet
Hz. Âişe (r.anhâ), Medine‟nin meşhur yedi fakihinden (fukahâ-i seb‟a) biridir ve onların
içindeki tek kadın sahabîdir. Hz. Ebû Bekir‟in (r.a.) kızı olması, yaşının genç olması, çocuğunun
olmaması, Hz. Peygamber (s.a.v.) ile evli olması ve zekası Hz. Âişe‟ye ilim yolunda derinleşme
imkanı sağlamıştır. Vahyin beşiğinde büyümüş, ilmî müktesebatıyla yaşadığı toplumda tek başına
adeta bir istişare kurulu vazifesi görmüştür. Bu açıdan Hz. Peygamberden naklettiği rivayetlerle, İslâm
aile hukuku başta olmak üzere kadının toplumdaki konumuyla ilgili konularda sonraki nesiller için
önemli bir kaynak teşkil etmiştir. Hz. Âişe‟nin, İslam‟ın doğuş ve gelişme aşamasında uzun bir
döneme şahit olması, bazı fırka ve mezheplerin ortaya çıkışını görmesi sebebiyle özellikle fıkıh
alanında yorumları ayrı bir önemi hâizdir. O, mezhepler teşekkül etmeden önceki süreçte mezheplere
kaynaklık etmiş ve bir kadın gözüyle mezhep imamlarına farklı bir bakış açısı kazandırmıştır. Hz.
Âişe‟nin her alanda fetvalarına rastlamak mümkündür. Ancak bu çalışma onun aile hukuku özelinde
rivayet ve içtihadları ile sınırlandırılmıştır. Bu çalışmada aile hukuku özelinde Hz. Âişe‟den gelen
hadis rivayetleri ve onun ilgili alandaki çeşitli konulardaki görüşleri ve değerlendirmeleri incelenecek
mezhep imamlarının bu rivayetler ve değerlendirmeler karşısındaki tutumlarının yanında günümüz
âlimlerinin değişen hayat şartları çerçevesinde bu meselelerdeki yorumları ele alınacak ve
değerlendirilecektir.
Hz. Âisha (r.anhâ) is one of the seven famous jurists of Medina, the only female jurist among the Companions whom we call fuqaha-i seb'a. Being the daughter of Hazrat Abu Bakr (r.a.), being young in age, having no children, being married to the Prophet (s.a.v.) and her intelligence enabled her to deepen in the path of knowledge. She grew up in the cradle of revelation and served as an advisory board in the society she lived in with her scholarly acquisitions. In this respect, with the narrations she transmitted from the Prophet, she constituted an important source for subsequent generations on issues related to the position of women in society, especially Islamic family law. Hazrat 'A'isha's comments, especially in the field of fiqh, are of particular impotance because she witnessed a long period during the emergence and development of Islam and saw the emergence of some schools of law. She was the source of the schools of law from a woman's point of view. It is possible to come across Hazrat 'A'isha fatwas in every field. However, this study is limited to her narrations and ijtihad in the field of family law. In this study, the hadith narrations from Hazrat 'A'isha and her opinions and evaluations on various issues in the field of family law will be examined, and the attitudes of the imams of the sects towards these narrations and evaluations, as well as the interpretations of today's scholars on these issues within the framework of changing life conditions will be discussed and evaluated.
