Özet
Türkiye ve Irak gibi birbirine komşu olan iki ülkenin kültürel, sosyal ve hatta siyasal birçok yönden birbirlerine benzer yönleri bulunmaktadır. Ancak Türkiye ve Irak hukukunda boşanmanın mali sonuçları dikkate alındığı zaman bazı farklar dikkat çekmektedir. Bu farklılıklardan dolayı bu çeşit araştırmaların yapılaması icap etmektedir. Evlilik kurumunun nihayete erip son bulmasına neden olan boşanma kurumunun birçok neticesi mevcut olmaktadır. Bu neticeler kişisel olduğu gibi mali de olmaktadır. Konumuzun asıl bölümü olan mali sonuçlara bakıldığında, mali sonuçlar; eşler arasında olduğu gibi çocuklar yönünden de ortaya çıkmaktadır. Bu çalışma kapsamında Türkiye ve Irak'ın de hukuk sistemi incelenerek, boşanma ve boşanmanın mali sonuçları ele alınacaktır. Yapılmış olan araştırmalar dâhilinde; Türk ve Irak hukukunda boşanma kavramı, boşanmanın dayandığı ilkeler boşanma hakkındaki görüşler, eşler ve çocuklar yönünden mali sonuçları ele alınmaktadır. Türk ve Irak Hukukunda boşanmanın mali sonuçlarını karşılaştırmak amacı ile yapılan bu çalışmanı ilk bölümünde boşanma kavramı üzerinde durulmuş, boşanma ile ilgili görüşler, boşanmanın dayandığı ilkeler ve boşanma davası ile ilgili durumlar iki ülkenin de hukukuna göre ele alınmıştır. Daha sonra her iki ülke hukuku açısından boşanmanın çocuklar açısından ve eşler açısından mali sonuçları üzerinde durulmuştur. Çalışma kapsamında, Boşanmanın mali sonuçları ile ilgili olarak her iki ülke yönünden (Türkiye - Irak) literatür araştırmaları yapılmış ve elde edilen bilgiler dahilinde iki ülkenin hukuk sisteminde yer alan boşanmanın mali sonuçları karşılaştırılmıştır.

However, when considering the financial implications of divorce law in Turkey and Iraq, some noteworthy differences. Due to these differences, this kind of research needs to be done. There are many consequences of the divorce institution, which led to the end and end of the marriage institution. These results are financial as well as personal. Considering the financial results, which is the main part of our subject, financial results; It occurs in terms of children as well as between spouses. This study also examined the scope of the legal system in Turkey and Iraq, the financial consequences of divorce and divorce will be handled. Within the researches made; The concept of divorce in Turkish and Iraqi law, principles on which divorce is based, opinions on divorce, financial consequences in terms of spouses and children are discussed. In the first part of this study, which was conducted in order to compare the financial consequences of divorce in Turkish and Iraqi Law, the concept of divorce was emphasized, opinions about divorce, principles on which divorce is based, and situations related to divorce proceedings were discussed in accordance with the laws of both countries. Then, the financial consequences of divorce in terms of children and spouses in terms of the laws of both countries were discussed. Work under the terms of the divorce both countries regarding financial results (Turkey - Iraq) and literature studies made on the information obtained from the financial consequences of divorce located in the two countries' legal systems are compared.
