dc.description.abstractEğitim kamu hizmetinin görülmesinde kamu özel ortaklığı başlıklı bu çalışmada ilk olarak, kamu özel ortaklığı genel olarak ele alınmış ve değerlendirmelere yer verilmiştir. Ardından ülkemizdeki eğitim sektörünün genel durumu incelenmiş ve kamu özel ortaklığı ile eğitim sektörü arasındaki ilişki ve bu bağlamda eğitim hizmetinde kamu özel ortaklığının kapsamı ele alınmıştır. Son olarak ise eğitim hizmetinde kamu özel ortaklığı kapsamında kurulacak sözleşmeler hakkında detaylı incelemelere yer verilmiştir. Bu çalışma kapsamında kamu özel ortaklığının tanımı, hukuksal niteliği, gerekliliği ve bu bağlamda yararları ve zararları, mukayeseli hukukta kamu özel ortaklığı uygulamaları, Türkiyede eğitim hizmetinin genel durumu, kamu özel ortaklığı ile eğitim hizmeti arasındaki ilişki, eğitim hizmetine ilişkin kamu özel ortaklıklarında sözleşmenin kapsamı, bu sözleşmelerin yapılması, uygulanması ve sona ermesi, bu sözleşmelerdeki tarafların sorumluluğu ve yargısal denetimi ayrıntılı bir şekilde incelenmiştir.en_US
dc.description.abstractThis article titled Public private partnership in education is constituted of three sections. In first section, public private partnership is analyzed and evaluated on general terms. In the second section, the general state of the education sector in our country is studied as well as the relationship between the public private partnership and education sector in addition to the scope of public private partnership in education service within this context. The third section provides a detailed analysis upon the contracts to be constituted in the education service within the scope of public private partnership. Within this scope, further analysis has been conducted on the definition of public private partnership, its legal feature and necessity, its advantages and disadvantages within that scope, public private partnership applications in comparative law, general state of education service in Turkey, the relation between the public private partnership and education service, the scope of the contract in public private partnerships in relation to education service, contracting these agreements as well as applying and concluding them, the obligations of the parties in this contract and its judicial review.en_US
