| dc.description.abstract | Tez çalışmamızla, 5237 sayılı Türk Ceza Kanunu 102. maddede düzenlenen ?cinsel saldırı? suçunu ayrıntılı olarak incelemeyi amaçlamış bulunuyoruz. Tez çalışmamız, iki ana bölümden oluşmaktadır. Birinci bölümünde ?cinsel saldırı suçunun tarihi gelişimi ve karşılaştırmalı hukuktaki görünüm?ü, ikinci bölümde ise ?cinsel saldırı suçu? tüm unsurları ile birlikte (TCK m.102) ele alınmıştır. Tez çalışmamızın birinci bölümünde, ?cinsel saldırı suçunun tarihi gelişimi ve karşılaştırmalı hukuktaki görünüm? kapsamında ilk olarak eski medeniyetlerin hukuk sistemlerinde cinsel saldırı suçu ele alınmış ayrıca günümüzde bir kısım önemli hukuk sistemlerinde cinsel saldırı suçu ana hatlarıyla incelenmiştir.Tez çalışmamızın ikinci bölümünde ise, 5237 sayılı Türk Ceza Kanunu'nda ?cinsel dokunulmazlığa karşı suçlar? kapsamında düzenlenen ?cinsel saldırı suçu? (TCK m.102) ayrıntılı olarak incelenmiştir. Bu kapsamda cinsel saldırı suçunda (TCK m.102), ?korunan hukuki yarar?, ?fail?, ?mağdur?, ?suçun konusu?, ?suçun unsurları? ve ?suçun özel görünüş biçimleri? ve bu başlık altında ?teşebbüs, ?içtima?, ?iştirak? konuları incelenmiştir. Çalışmanın ikinci bölümde ayrıca ?cinsel saldırı suçunun nitelikli halleri? kapsamında ?suçun vücuda organ veya sair cisim sokulmak suretiyle işlenmesi? (TCK m.102/2) ve cinsel saldırı suçunda cezanın ağırlaşmasına neden olan diğer nitelikli haller (TCK m.102/3) ayrıntılı olarak ele alınmış ve ?cinsel saldırı suçunun neticesi sebebiyle ağırlaşmış halleri? (TCK m. 102/5-6) ile ?cinsel saldırı suçu ve benzer suçlar ayrımı?, ?şikâyet-uzlaşma? ve ?görev-yaptırım? konularına yer verilmiştir. | en_US |
| dc.description.abstract | The aim of our thesis study is to examine the crime of ?sexual assault? which is regulated by Article 102 of the Turkish Penal Code No 5237 in detail. Our thesis study is composed of two main chapters. In the first chapter of our study, ?the historical development of the crime of sexual assault and its perspective within comparative law? is presented and in the second chapter ?the crime of sexual assault? is discussed with all the essential elements (TPC Article 102). In the first chapter of our thesis, within the scope of ?the historical development of the crime of sexual assault and its perspective within comparative law?, first, the crime of sexual assault is discussed within the context of the justice systems of ancient civilizations, furthermore, the crime of sexual assault is examined in general terms within certain important justice systems of our day. In the second chapter of our thesis study, ?the crime of sexual assault?, which is regulated within the scope of ?crimes against sexual inviolability? in the Turkish Penal Code No 5237 is examined in detail. Within this scope, the topics of ?protected legal benefit?, ?perpetrator?, ?aggrieved?, ?the subject of the crime?, ?the elements of the crime? and ?special aspects of the crime? and under this title the topics of ?attempt?, ?assembly? and ?participation? are examined. Furthermore, in the second chapter of the study ?commitment of the crime by inserting an organ or another object into the body? (TPC Article 102/2) and other major aspects which result in the aggravation of the punishment in case of sexual assault (TPC Article 102/3) are discussed in detail within the scope of ?major aspects of the crime of sexual assault? and ?aggravated states of sexual assault due to its result? (TPC Article 102/5-6) and the topics of ?the distinction between the crime of sexual assault and similar crimes?, ?complaint- settlement? and ?duty-sanction? are also presented. | en_US |
