| dc.description.abstract | Çalışmamızda, İslam ve Osmanlı Hukuk Tarihi açısından son derece önemli olan Mecelle-i Ahkam-ı Adliyye'nin, Mecelle Ta`dil Komisyonu tarafından ta`dil edilen maddelerinin İslam Hukuku açısından değerlendirmesini yapmaya çalıştık. Ta`dil Komisyonu'nun, Kitabu'l-Buyû'un 20 maddesinin değiştirilmesini, bu bölüme 10 madde ilave edilmesini ve bu bölümden 13 madde çıkarılmasını, Kitabu'l-İcare'de ise, 10 maddenin değiştirilmesini ve 13 maddenin ilave edilmesini teklif ettiğini tespit ettik. Ta`dil Komisyonu'nun, ta`dil çalışmalarını yaparken, Mecelle'nin zamanın ihtiyaçlarını karşılayabilecek bir kanun haline gelebilmesi için, Osmanlı Devleti'nin resmi mezhebi olan Hanefi mezhebinin dışında, başka mezheplerin görüşlerini de tercih ettiğini gördük. Ta`dil çalışmalarında en fazla Hanefi mezhebine, daha sonra Maliki mezhebine, daha sonra Hanbeli mezhebine ve en az da Şafii mezhebine başvurulduğunu tespit ettik. | en_US |
| dc.description.abstract | In our research, we tried to evaluate of Mecelle? s amended articles that were amended by Mecelle Amendment Commission are very important for Islamic and Ottoman Law History. We determined that Amendment Commission offered the change of Kitabu?l Buyu?s 20th article, addition 10 article to this part and deduction of 13 article from this part. Furthermore, it was offered to alter 10 articles and to add 13 articles to Kitabu? l Icare. During the amendment research of Amendment Commission, it was found out that Amendment Commission asked for the opinions of sects other than Hanefi which was official sect of Otoman Empire in order to form Mecelle as a law that meets the demands of that era. It was also found out that the opinions of sects were asked according to the order from the most to the least as Hanefi, Maliki, Hanbeli and Safii. | en_US |
