Özet
Demokratik bir sistemde siyasi partilerin görevlerini yerine getirebilmeleri, politikalarını halka duyurabilmeleri ve en önemlisi de seçim dönemlerinde kampanyalarını yürütebilmeleri, mali açıdan büyük bir külfeti de beraberinde getirmektedir. Siyasi partilerin finansmanına ilişkin tartışmalar ise, genellikle iki konu üzerinde odaklanmaktadır. Bunlar, siyasi partilerin gelir ve giderlerine ilişkin olarak yapılan düzenlemeler ile siyasi partilerin finansmanının denetimi konularıdır. Siyasi partilerin finansmanının mali denetimi konusunda, partilerin rutin faaliyetleri ile seçim kampanyası faaliyetlerinin finansmanı konusunda ayrım yapılmaktadır. Siyasi partilerin rutin faaliyetleri hakkında yapılan denetim genellikle yıllık olarak yapılmaktadır. Siyasi partilerin seçim kampanyası faaliyetleri ile ilgili denetim ise, kanunla belirlenmiş seçim süreci boyunca partilerin gelirleri ve harcamaları ile ilgili olarak yapılmaktadır. Dört bölümden oluşan bu çalışmada, siyasi partilerin seçim harcamalarının denetimi konusu incelenmiştir. Birinci bölümde, genel olarak siyasi partilerin mali kaynakları konusu üzerinde durulmuştur. İkinci bölümde, siyasi partilerin seçim harcamalarının düzenlenmesine ilişkin olarak benimsenen kurallar ve başta denetim mekanizmaları olmak üzere bu kuralların uygulanmasına yönelik olarak alınan tedbirler incelenmiştir. Üçüncü bölümde, siyasi partilerin veya adayların seçim harcamalarının denetimiyle ilgili düzenleyici bir sistem oluşturan ülkeler, örnekleme yoluyla seçilip incelenmiş ve bu sistemlere ilişkin değerlendirmeler yapılmıştır. Son bölümde ise, Türkiye'de siyasi partilerin mali denetimi konusu ve seçim harcamalarının denetimine yönelik güncel gelişmeler incelenmiştir. Ayrıca, Türkiye'de seçim harcamalarının denetimiyle ilgili oluşturulması muhtemel sisteme ilişkin önerilere yer verilmiştir.
In a democratic system to sustain their functions, to announce and publicize their policies to the public and above all to sustain their campaigns during elections bring great financial expenses to the parties. The discussions on the financing of the political parties generally focus on two topics. These are the regulations on the incomes and expenses of the political parties and the control of the financing of the political parties. There is a distinction between routine activities of the political parties and election campaign costs related to the financial control of the political parties. The control on the routine activities of the political parties is carried out annually. The control on the election campaign expenses of the political parties, on the other hand, is carried out during the election period stated by the legislation on the income and expenses of the parties. In this study which is made up four sections the subject of control on the expenses of political parties is dealt with. In the first section, generally financial sources of the parties are examined. In the second section the rules accepted for the regulation of the expenses of political parties and precautions that were accepted to control the implication of the afore mentioned rules. In the third section countries that have regulative systems on the election expenses of the candidates and parties were randomly selected and examined and evaluations on the system have been made. In the last section, contemporary changes on the control of the election expenses and financial control of the political parties have been examined. In addition, suggestions on the possible system to be performed on the control of the election expenses were made.
