| dc.description.abstract | Bölge adliye mahkemeleri ikinci derece görev yapmak üzere kurulmuş olan mahkemelerdir. lk derece mahkemesinin kararını hem maddû açıdan hem de hukukû açıdan incelemekle görevlidir. Bölge adliye mahkemelerinin kurulmasıyla Yargıtay maddû inceleme yapmayacaktır, sadece hukukû inceleme yapacaktır. Böylece Yargıtay esas görevi olan, ülkede hukuk birliğini sağlama görevini en iyi şekilde yerine getirecektir. Bölge adliye mahkemeleri hukuk ve ceza dairelerinden oluşan bir mahkemedir. Daireler kurul halinde çalışır. Başka bir deyişle toplu mahkeme olarak örgütlenmişlerdir. Bu durum da bölge adliye mahkemelerine olan güveni artıracak bir niteliktir. Bölge adliye mahkemelerinde uygulan yargılama usulü istinaf kanun yolu usulüdür. stinaf kanun yolunda hem maddû hem de hukukû inceleme vardır. Ayrıca bölge adliye mahkemesi, ilk derce mahkemesi kararına kaldırarak yeni bir karar verebilmektedir. Bizim hukukumuzda dar anlamda istinaf kabul edilmiştir. Bu nedenle ilk derece mahkemesinde taraflarca ileri sürülmeyen iddia ve savunmalar, bölge adliye mahkemesinde de ileri sürülemez. | en_US |
| dc.description.abstract | The courts of regional judicial system are established for making duty in the second degree. This courts are duty on the study of first degrees courts judgments on real and legal. By the established the courts of regional judicial system, The Supreme Courts of Appeals are not duty on the study of real, only duty on the study of legal. So that The Supreme Court of Appeals are duty on basis duty that; providing the unity of law, make very good. The courts of regional judicial system are consist of law and criminal public office. So that this courts are combined courts. Because of the combined corts, tis fact is incrased the trust of this courts. In the courts of regional judicial system applicated trial procedure is appeal procedure. In the appeal procedure, studied on real and legal duty. | en_US |
