Abstract
Suçsuzluk karinesi, kişinin suçluluğu mahkeme kararı ile kesinleşene kadar suçsuz sayılmasını ifade eden bir ilkedir. Adil yargılanma hakkının en önemli usurlarından biridir ve temel bir haktır. Aydınlanma çağının çok önemli bir kazanımı olarak ortaya çıkmış, zaman içinde tüm dünyaya yayılmış ve artık tüm dünyada kabul görmüş bir hukuk prensibidir. Suçsuzluk karinesi, güçlü Devlet otoritesi karşısında, suçlanan herkesi korumayı amaçlar. Bu karineye göre ispat yükü iddia makamına aittir. Sanık suçsuzluğunu ispat etmek zorunda değildir. Suçluluğunun ispat edilememesi halinde ise, şüpheden sanık yararlanır. Sanığın susma hakkı vardır. Bu hakkı kullanmış olması kendi aleyhine sonuç çıkarılması anlamına gelmez. Hukuka aykırı deliller ile sanığın suçlu bulunması karineye aykırılık oluşturur. Soruşturmanın başlangıcından kesin hüküm verilinceye kadar şüpheli ve sanık hakkında kesin bir mahkûmiyet kararı varmış gibi suçluluğundan söz edilemez. Suçsuzluk karinesi, suç soruşturması ve kovuşturması aşamasında hâkim, savcı ve tüm kamu görevlileri için geçerli bir ilkedir. Bunlara ek olarak medya organlarının da, kesin hüküm öncesi soruşturma ve kovuşturma aşamasında suç konusunda haberler verdikleri esnada kullandıkları ifadelere özen göstermelidirler.
Presumption of innocence is a principle that expresses a person's innocence until his/her guilt is confirmed by a court decision. It is one of the most important principles of the right to a fair trial and it is a fundamental right. It has emerged as a very important achievement of the Enlightenment age and spread all over the world in time and it is a law principle that is now accepted all over the world. The presumption of innocence aims to protect all those charged against strong State authority. According to this presumption, the burden of proof belongs to the prosecution. The defendant does not have to prove his innocence. If his/her criminality can not be proven, the defendant takes advantage of the suspicion. The defendant has the right to remain silent. The fact that he/she has exercised this right does not mean to draw conclusions against him/her. Finding the defendant guilty with unlawful evidence is contrary to the presumption. From the beginning of the investigation until the final verdict is given, it is not possible to talk about the criminality of the suspect and the defendant as if there was a final conviction. The presumption of innocence is a principle applicable to judges, prosecutors and all public officials during the criminal investigation and prosecution phase. In addition, the media should pay attention to the statements they used while reporting the crime during the pre-verdict investigation and prosecution phase.
