Özet
Her kural yoruma, her yorum ise belli bir yöntem dâhilinde yapılmaya muhtaçtır. Hukuk da kurallar bütünü olması hasebiyle yoruma ihtiyaç duyulan bir alandır. Yöntemin bilimsel olup olmaması bu aşamada pek fazla önem arz etmese de yapılacak yorumda kullanılan yöntemlerin, metnin anlamsal bütünlüğü çerçevesinde tutarlılık göstermesi gerekmektedir. Bu doğrultuda yargıç da kararını verirken bir yöntem dâhilinde ilerlemektedir. Uygun yöntemler dâhilinde yapıldığında, bu durum hem karar sürecini hızlandıracak hem de verilecek kararın adil olmasına katkıda bulunacaktır. Ülkemizde üzerine pek fazla araştırma yapılmamış olsa da Avrupa İnsan Hakları Mahkemesi’nin kararlarını verirken göz önünde bulundurduğu yorum yöntemleri de mevcuttur ve hayati ehemmiyet arz etmektedir. Zira verilen her karar bir yorumu gerektirmekte, yapılan her yorum ise belli başlı bazı yöntemler takip edilerek oluşturulmaktadır. Bu çalışmada da kuşatıcı bir perspektifle ve daha önce AİHM’in verdiği kararlar ışığında yorum yöntemleri ortaya konulmaya çalışılmıştır.
Every rule needs interpretation and every interpretation needs to be made within the specific methods. Law is also composed of rules and therefore it needs to be interpreted. At this phase, it is not very important whether the method is scientific or not. However, methods which are going to be used in interpretation require to be consistent. In a decision making process, judge improves his opinions within the specific method. If the method is applied appropriately, it will speed up the process and contribute the fairness of decision. In our country; although the methods which are used by European Court of Human Rights in the decision making process are not much researched, they are significantly important; because every decision which is given by ECHR requires interpretation and this interpretation also be created by following some major methods. This study aims to approach this topic by comprehensive perspective and in the light of judgments of ECHR.
