dc.description.abstractHukukumuzda kamu mallarına ilişkin temel bir kanun bulunmamaktadır. Kamu tüzel kişilerinin üzerinde özel mülkiyet kurulmamış mallarına kamusal mal denir. Doktrindeki hâkim görüşe göre, idare ile kamu malları arasındaki hukuki ilişki kamu mülkiyeti ilişkisidir. Kamu mülkiyeti kamu hukuku kurallarından kaynaklandığından özel mülkiyetten farklıdır; ancak değişik ölçülerde de olsa onun gibi kullanma, yararlanma ve tasarruf yetkilerini içerir. Buna karşılık başta Anayasa (m.43) olmak üzere birçok kanunda “Devletin hüküm ve tasarrufunda” (DHvTA) olma deyimi kullanılmaktadır. Bu deyim bazen sâdece belirli mal kategorilerini ifade etmekte, bazen de idarenin her türlü malını kapsamaktadır. Terimin mülkiyet öncesi bir denetim ve gözetim yetkisi anlamına geldiği de belirtilmektedir. DHvTA olma doğrudan Devletin belirli malları üzerindeki hükümranlık hakkını gösteren bir terimdir. Terim kamu hukuku kurallarının uygulandığı, kamu yararını sağlamaya yönelik, kamu malını hem birey ve topluluklara hem de Devlete karşı koruma garantisi veren bir kuralı içeren, özgül ve özgül bir kamu mülkiyeti ilişkisi demektir. DHvTA olma malın özel mülkiyete konu edilmesini mutlak surette yasaklamaktadır.en_US
dc.description.abstractThere is no fundamental law regarding public goods in our law. In theory, goods belonging to a public legal entity but on which no private property has been established are called public domain. According to the dominant view in the doctrine, the legal relationship between the administration and the public property is the public property relationship. The public property differs from private property in that it arises from the rules of public law; however, it includes the authority to use, benefit and dispose of it, albeit to a different extent. On the other hand, in many laws, especially in the Constitution (art. 43), the phrase being “under the imperium and disposal of the State" is used. This phrase sometimes only refers to certain categories of goods, and sometimes covers all kinds of goods of the administration. It is also stated that the term means a pre-ownership control and oversight authority. Being under the imperium and disposal of the state is a term that directly denotes the right of sovereignty over certain property of the State. The term refers to a unique and specific public property relationship in which the rules of public law are applied, aimed at the public interest, containing a rule that guarantees the protection of public domain both to individuals and communities and the state. Being under the imperium and disposal of the state absolutely prohibits the subjection of public domain to private ownership.en_US
