| dc.description.abstract | Koşullu salıverilme, hükümlünün mahkum olduğu hapis cezasının kanunda belirlenen kısmını cezaevinde iyi halli olarak geçirmesi durumunda, belirlenen şartlara uymadığı takdirde koşullu salıverilme kararının geri alınması şartıyla, merciince alınacak kararla salıverilmesini sağlayan bir kurumdur. Koşullu salıverilme, Türk infaz hukukunda önemli yeri olan tamamlayıcı niteliğe sahip bir kurumdur. Koşullu salıverilme kurumu, hükümlüyü topluma kazandırmayı, hükümlüyü cezaevinin olumsuz şartlarından korumayı, hükümlünün tekrar suç işlemesini önlemeyi amaçlamaktadır. Ayrıca koşullu salıverilme hapis cezasının bireyselleşmesini sağlamaktadır. Bunun yanı sıra hükümlünün ıslah edilmesinde önemli bir araçtır. Koşullu salıverilme ile, hükümlü kanunda öngörülen şartları sağladığı takdirde salıverilmekte ve kalan cezasını ceza infaz kurumu dışında denetim altında infaz etmektedir. Hükümlü, denetim süresini iyi halli bir şekilde geçirdiği takdirde cezası infaz edilmiş sayılmakta ancak yükümlülüklerine uygun davranmadığı takdirde hakkında belirli yaptırımlar uygulanmaktadır. Üç bölümden oluşan bu çalışmamızda tartışmalı konular da ele alınarak koşullu salıverilme kurumu incelenecektir. | en_US |

Conditional release is a complementary institution that has an important place in the Turkish Enforcement Law. It aims to provide the convict, to provide the convict, to protect the unfavorable conditions of the prison and to prevent the convict from committing a crime again. In addition, conditional release allows the prison sentence to be individualized. Besides, a meeting in the correction of the convict. With conditional release, the convict must be provided by law, with conditional release to learn under penal institution supervision.
