| dc.description.abstract | Türkiye uyuşturucu maddelerle mücadele etmeye çok erken tarihlerde başlamasına rağmen bu maddelerin ticaretinin ve kullanımının yaygınlaşmasını engelleyememiştir. Uluslararası alanda imzalanan birçok sözleşmenin tarafı olarak bu konuda kararlılığını göstermiştir. İç hukukunu uluslararası alanda imzalanmış sözleşmelerle uyumlu hale getirmek için yasalarda gerekli değişiklikleri yapmıştır. Uyuşturucu madde ile ilgili olarak iç hukukumuzda temel olarak üç tane kanun bulunmaktadır. Bunlar, 2312 sayılı Uyuşturucu Maddelerin Murakabesine Dair Kanun, 3298 sayılı Uyuşturucu Maddelerle İlgili Kanun ve 5237 sayılı Türk Ceza Kanunu?dur. Tez konumuz olan uyuşturucu veya uyarıcı madde imal ve ticareti suçu, Türk Ceza Kanunu?nun 188. maddesinde düzenlenmektedir. Bu düzenleme çerçevesinde, uyuşturucu veya uyarıcı maddelerin ruhsatsız veya ruhsata aykırı olarak imal, ithal ve ihraç edilmesi yaptırım altına alınmıştır. Diğer taraftan uyuşturucu maddelerin ruhsatsız veya ruhsata aykırı olarak satılması, satın alınması, satışa arz edilmesi, nakledilmesi, depolanması, sevk edilmesi, bulundurulması yaptırım altına alınan diğer eylemlerdir. Uyuşturucu maddelerin eroin, kokain, morfin veya baz morfin olması, bir örgütün faaliyeti çerçevesinde işlenmesi ve bazı meslek mensuplarının bu suçu işlemeleri halinde verilecek cezanın artırılması sistemi benimsenmiştir. Uyuşturucu madde olmamakla birlikte uyuşturucu yapımında kullanılan maddelerin imal ve ticaretinin önlenmesine yönelik hükümler getirilmiştir. | en_US |
| dc.description.abstract | Turkey started to struggle with drug trafficking in very early time however it did not prevent use and trafficking of drug from being spread. As a party of many international conventions, it showed how much it was determined to struggle with the drug trafficking. Turkey modified its domestic legislations regarding the drug trafficking in order to be comply with the international conventions. There are three legislations in Turkish law regarding the drug issues. These are The Code on Supervision of The Drug Substances Numbered 2312, The Code Relating The Drug Substances Numbered 3298 and Turkish Criminal Code Numbered 5237. The crime on drug trafficking we are studying on is provided for Article 188 of Turkish Criminal Code. According to this article, it is prohibited to producing, import and export of the drug substances in a way that it is contrary to licence or without licence. On the other hand, selling, purchasing, tranporting, supply, storing, oferring for selling and possession of the drug substances in way that it is contrary to licence or without licence are also forbidded and punishable acts. If the drug substances are heroin, cocain, morphine and morphine base, the punishment given by the court shall be raised. The aim of this provision is to ensure society more protection. In addition, in case that this crimes is committed by illegal terror organization which is established to materialize illegal activities, the punishment given by the court shall be raised. This provivision is also in practice in case that some persons such as doctor, nurse, dentist, pharmacist etc. commit this crime since committing this crime is very easy for them, who have a specific knowledge on drug issues. | en_US |
