Özet
Sendika özgürlüğü ilkesine göre; isçiler istedikleri zaman istedikleri sendikaya üye olabilirler, kurulmuş bulunanlardan başka sendika kurabilirler veya hiçbir sendikaya üye olmayabilirler. Bu durumda, hiçbir sendikaya üye olmayan isçiler ile o işyerinde uygulanmakta olan toplu is sözleşmesinin tarafı isçi sendikasının dışındaki bir sendikaya üye olan isçilerin, işyerinde uygulanmakta olan toplu is sözleşmesi hükümlerinden yararlanıp yararlanamayacakları problemi iş Hukukunun önemli konularından biri olarak ortaya çıkmaktadır. Bu problemin çözümünde, sendika özgürlüğü ile sendika güvenliğini
bağdaştıracak bir orta yol menfaatler dengesine daha uygun düşecektir. Bu sebeple;
genelde toplu is sözleşmesinden yararlanma kural olarak taraf sendika üyelerine
tanınacak, taraf sendika üyesi olmayanlar ise bir karsılık ödemeleri şartıyla toplu is
sözleşmesinden yararlanabileceklerdir. Türk Hukukunda da kural, taraf sendika üyelerinin toplu is sözleşmesinden yararlanmasıdır. İstisnaları ise, dayanışma aidatı ödeyerek ve sendikanın yazılı muvafakatiyle toplu is sözleşmesinden yararlanmadır.
