Özet
Bir yüksek lisans tezi olan bu çalışmanın konusu "Bilişim Alanında Suçlar"dır. Fakat öngörüleceği gibi bu çalışmaya özellikle "Bilişim Suçları?" başlığı koyulmamıştır. Çünkü bu kavramla gerek bilişim sistemine karşı gerekse bilişim sistemi vasıtasıyla işlenen suçlar sözkonusu olacaktı. Dolayısıyla yüksek lisans tezi doktora tezine dönüşecekti. Bu çalışmada sadece bilgisayara karşı işlenen suçlar incelenmiştir. Bilgisayar vasıtasıyla işlenen çocuk pornografisi, dolandırıcılık, sahtekarlık, banka ve kredi kartlarının kötüye kullanılması inceleme alanının dışındadır. Bu çalışma iki bölüme ayrılmıştır. Birinci bölümde bilişim, bilişim alanı, bilgisayar, veri, program gibi teknik bilgi gerektiren kavramlar incelendi. İkinci bölümde ise eski ve yeni ceza konularındaki düzenlemeler ve ilgili Yargıtay kararları ayrıntılı olarak ele alındı. Yeni TCK'nun bilişim alanında suçlar kısmına, Budapeşte'de imzalana "Convention On Cyber Crimes?" kaynak oluşturmuştur. Bu çalışmada kanun maddelerinin ilgili olduğu Siber Suç Sözleşmesindeki maddelere de yer verilmiştir. Son olarak da uluslararası alandaki düzenlemeler ve yeni bilişim taslağına değinilmiştir.
The theme of this master?s thesis is ?Crimes At Information Technologies Area?. But as well as predicted this thesis hadn?t been named as ?Information Technologies Crimes?. Because by this structure it would be both understood as directly or indirectly information technologies crimes. So this thesis would have converted into a Ph. D. thesis. In this thesis, only direct information technology crimes committed towards computer had been searched. Crimes which are committed by the help of computer like child pornography, fraud, abuse of bank and credit cards are out of our research are. This thesis is divided into two sections. In the first section, explanations such as information technology, information technology area, computer, data, program were researched. In the second section, the regulations in the ex and new punishment law with the extra support of Supreme Court?s verdicts were searched. New Turkish Punishment law is based on the ?Convention On Cyber Crimes? treaty which was signed in Budapest. In this thesis, the Juristic regulations related to Cyber Crime Convention had been given. At last, the Juristic regulations in international law systems and new information technology law project had been mentioned.
