Özet
İbraname, tarafların aralarında anlaşarak mevcut bir borcu ortadan kaldırdıkları sözleşmedir. Borçlar Kanunu'nda ibranameye ilişkin bir düzenleme yer almadığından, bu eksiklik doktrindeki görüşler ve Yargıtay kararları ile giderilmekteydi. İbraname, 01.07.2012 tarihinde yürürlüğe giren Türk Borçlar Kanunu'nda düzenlenmiştir. Uygulamada sıklıkla taraflar bir borcu ortadan kaldırmak, borçluyu borçtan kurtarmak amacıyla ibraname düzenlemektedir. Türk Borçlar Kanunu'nda ibranamenin, Borçlar Hukuku ve İş Hukuku alanındaki görünümü farklı şartlarda düzenlenmiştir. Borçlar Hukuku alanındaki ibraname, sözleşme özgürlüğü ilkesi ve genel hükümler çerçevesinde değerlendirilmiştir. İş Hukuku alanında işçilik alacakları için düzenlenen ibraname ise çok sıkı geçerlilik şartlarına bağlanmış ve "tam ifa" veya belirli şartlarda "kısmı ifa" halini ispatlamaya yarayan bir belge niteliğine bürünmüştür. Çalışmanın ilk bölümünde ibranamenin Borçlar Hukuku alanındaki görünümü, ikinci bölümünde İş Hukuku alanındaki görünümü, kanuni dayanakları, ibraname ile benzer kurumların ortak yönleri ve farkılıkları, doktrindeki görüşler ve Yargıtay kararlarıyla birlikte ele alınmış, Türk Borçlar Kanunu öncesinde ve sonrasındaki dönemler kıyaslanarak incelenmiştir.
Release is a contract in which the parties agree to eliminate an existing debt. Since there was no regulation regarding the release document in the Code of Obliga-tions, this deficiency was eliminated by the opinions in the doctrine and the decisi-ons of the Supreme Court. The release is regulated in the Turkish Code of Obligati-ons, which came into force on 01.07.2012. In practice, the parties often issue a discharge in order to eliminate a debt and relieve the debtor from the debt. In the Turkish Code of Obligations, the appearance of the release in the field of Law of Obligations and Labor Law is regulated under different conditions. Release in the field of Law of Obligations has been evaluated within the framework of the principle of freedom of contract and general provisions. The release issued for labor receivables in the field of Labor Law is subject to very strict validity conditions and has become a document used to prove "full performan-ce" or "partial performance" under certain conditions. In the first part of the study, the appearance of the discharge in the field of Ob-ligations Law, in the second part, the appearance of the discharge in the field of La-bor Law, its legal basis, the common aspects and differences of the discharge and similar institutions, together with the opinions in the doctrine and the Supreme Co-urt decisions, were examined by comparing the periods before and after the Turkish Code of Obligations.
