| dc.description.abstract | Birinci bölümde; Türk Medeni Kanunu'ndaki aile hukuku reformu, aile ve ailenin korunması konuları genel hatları ile incelendikten sonra, konumuzun ana esasını teşkil eden ancak Türk Medeni Kanunu'nda tanımı yapılmayan Aile Konutu'nun ne olduğunu daha iyi anlayabilmek için 'aile' ve 'konut' kavramları tek tek incelenerek Aile Konutu kavramı hakkında Türk doktrininde yer alan tanımlamalar ile bir sonuca varılmaya çalışılmıştır. Daha sonra aile konutunu oluşturan unsurlar ve aile konutunun önemi açıklanmaya çalışılmış ve Türk Medeni Kanun'unun evliliğin genel hükümleri, mal rejimleri ve miras hukuku bölümlerinde yer alan aile konutu hükümleri ayrıntılı olarak incelenmiştir. İkinci bölümde, aile konutunun ne olduğu belirtildikten sonra, bu konut üzerinde üstün hak sahibi olan eşin, bu hak sahipliğinin niteliğini ve söz konusu haklarını kullanırken hangi hukuki işlemlerin TMK. m. 194 kapsamında, diğer eşin rızasını gerektireceği hususu açıklanmıştır. Üçüncü ve dördüncü bölümde, TMK. md. 194 gereği zorunlu olan diğer eşin rızasının hukuki niteliği, rıza vermemenin sonuçları ve rıza vermekten kaçınma halinde, hak sahibi eşin TMK. m. 194/II gereği mahkemeden tek başına yetki talebi ile son bölümde TMK. md. 194/III ile getirilen aile konutu şerhinin hukuki niteliği incelenmiştir. | en_US |
| dc.description.abstract | The subject of this dissertation is "FAMILY DWELLING and THE ANNOTATION". The dissertation consists of four chapters except introduction and conclusion parts. In chapter I, during this study, in the first section, in order to apprehend the family dwelling which makes up the core structure of the subject but which has no accurate definiton in the Turkish Civil Code, it was tried to have a conclusion with the definitions which exist in the Turkish Doctrine about the concept of the Family Dwelling after discussing the family and the dwelling deeply. After that, it was tried to review the importance of family dwelling and the elements are forming it and the general provisions of the marriage, property regimes in the Turkish Civil Code and the provisions of housing including in the section of inheritance law has been examined in detail. In Chapter II, following the definition of family dwelling, the nature of the titleholder of the wife/husband is explained and the legal actions that are required the consent of the wife/husband within the scope of Article 194 of the Turkish Civil Code are presented. In Chapter III and IV, the nature of the wife/husband's consent that is required within the scope of Article 194 of the Turkish Civil Code, the consequences of the consent is not granted and in such case the authorization request of the titleholder wife/husband from the court in accordance with Article 194/III of the Turkish Civil Code are analyzed as well as the nature of the annotation of family dwelling in the last chapter as regulated under Article 194/III of the Turkish Civil Code. | en_US |
