dc.description.abstractTemyiz, mahkeme kararlarındaki hukuka aykırılıkları gidermek amacı ile kabul edilen hukuki derece kanun yoludur. Temyiz nedeni olarak hukuka aykırılık, temyiz başvurusunun sebebini oluşturur. CMK’da temyizde taleple bağlı bir yargılama sistemi kabul edildiğinden yapılacak denetim sadece temyiz başvurusunda belirtilen noktalarla sınırlıdır. Temyiz eden, hükmün neden dolayı bozulmasının istediğini temyiz başvurusunda göstermek zorundadır. Temyiz dilekçesinde temyiz sebeplerinin gösterilmemesi Yargıtay tarafından temyiz isteminin reddi kararı verilmesine yol açar. Bu çalışmada temyiz isteminde ileri sürülen hukuka aykırılık iddiasının temyiz talebinin gerekçesini ne ölçüde somutlaştırdığı, temyiz isteminde hiçbir sebep gösterilmediği veya ileri sürülen gerekçe geçerli görülmediği takdirde CMK m.289’da sayılan kesin hukuka aykırılık hallerinin denetlenip denetlenemeyeceği ve sebep gösterme zorunluluğunun yerindeliği hususları, mahkeme kararları doğrultusunda değerlendirilmiştir.en_US
dc.description.abstractThe acquisition of citizenship through marriage is regulated in Article 16 of the Turkish Citizenship Law No. 5901 (TVK). According to the provision, “(1) Marriage with a Turkish citizen does not directly acquire Turkish citizenship. However, foreigners who have been married to a Turkish citizen for at least three years and whose marriage continues can apply to acquire Turkish citizenship”. In the continuation of the provision, the conditions sought for "applicants" are listed in three subparagraphs. These; a) Living in the unity of the family, b) Not engaging in an activity incompatible with the marriage union, and c) Not in a situation that would constitute an obstacle in terms of national security and public order [(art. 16/1(a,b,c)]. The conditions are sought for the foreign spouse who wants to acquire Turkish citizenship by marriage. However, in practice, it is seen that the conditions mentioned in some decisions of the 10th Civil Chamber of the Council of State and the Board of Administrative Case Chambers are sought for a Turkish citizen spouse too. By stating that this practice is against the Law, in our study, the acquisition of Turkish citizenship through marriage will be evaluated within the framework of the conditions stipulated in the TVK and it will be pointed out that these are not sought for Turkish citizen spouses.en_US
