Özet
Adaletin tecelli etmesinde avukatların rolü tartışılamaz. 'Türk Avukatlık Hukukunun Arnavutluk Avukatlık Hukuku İle Karşılaştırılması' isimli bu çalışmamızda genel hatlarıyla belirtmek gerekirse şu şekilde bir yöntem kullanılacaktır. Tez çalışmamız: Giriş, Türk Avukatlık Hukuku, Arnavutluk Avukatlık Hukuku, iki ülke avukatlık hukuklarının mukayesesi ve sonuç bölümlerinden oluşacaktır. Birinci bölümde, Türk avukatlık hukuku açıklanmaya çalışılmış olup. Başlıca olarak avukatlık mesleğinin nitelikleri, avukatlık mesleğine kabul şartları, avukatın hak ve yetkileri, avukatın yükümlülükleri, avukatların kamu niteliğindeki meslek örgütleri ele alınarak değerlendirilmiştir. İkinci bölümde, Arnavutluk avukatlık hukuku açıklanmaya çalışılmıştır. Başlıca olarak avukatlık mesleğinin nitelikleri, avukatlık mesleğine kabul şartları, avukatın hak ve yetkileri, avukatın yükümlülükleri, avukatların kamu niteliğindeki meslek örgütleri ele alınarak açıklanmıştır. İki ülke avukatlık hukuklarının mukayesesi bölümünde Türk avukatlık hukuku ile Arnavutluk avukatlık hukuku arasında bulunan farklar ve benzerlikler açıklanmaya çalışılmıştır. Sonuç bölümünde bu konu ile ilgili yorumlarımıza yer verilmiştir. Ayrıca bu bölümde Arnavutluk avukatlık hukukunda bazı konulara ilişkin eleştirilerimize ve mesleğin itibarının zedelenmemesi adına bu konulara ilişkin önerilerimize yer verilmiştir. Yapmış olduğumuz bu analiz gerek kendi görüşlerimiz gerekse konunun uzmanlarının ve değerli hocalarımızın görüşleriyle birlikte desteklenmiş olup bu çalışmada iki ülke avukatlık hukukuna daha çok yönlü bakma ve bu iki ülke avukatlık hukukunu mukayese etme imkânı sunulmaya çalışılmıştır.
In order for justice to come true the role of lawyers is undisputed. In our work named 'The Comparison Between Turkish Attorney Law and Albanian Attorney Law' in general this is the method used. Our study: will consist of entrance, Turkish Attorney Law, Albanian Attorney Law, the comparison between two countries? attorney legal framework and the result. In the first part, we tried to explain the Turkish Attorney Law. First of all, we evaluated and explained topics such as: The characteristics of attorney profession, the criterions of admission, the right and the competences of attorney, the obligation of attorney and the attorney organizations in public sector. In the second part, we tried to explain Albanian Attorney Law. First of all, we evaluated and explained topics such as: The characteristics of attorney profession, the criterions of admission, the right and the competences of attorney, the obligation of attorney and the attorney organizations in public sector. In the part of comparison between two countries? attorney legal framework, we explained the similarities and differences between Turkish Attorney Law and Albanian Attorney Law. In the result part, we gave place to our opinions regarding this topic. Additionally we expressed our critics about some topics in the Albanian Attorney Law and we gave our suggestions in order to protect job reputation from being outraged. The analysis made in this study, which is supported by our opinions, the specialists and our precious professors? opinions, gives us the possibility to look at both countries attorney law at a wide aspect and compare their attorney laws.
