| dc.description.abstract | Tüketici Hukuku son yıllarda en hızlı gelişen ve önemi artan hukuk dallarından biridir. Tüketimin artması bu konudaki düzenlemelerin de yapılmasını ve zamana göre yenilenmesini zorunlu kılmıştır. Bu konuda yapılan ilk düzenleme 08.09.1995 tarihinde yürürlüğe girmiş olan 4077 sayılı Tüketicinin Korunması Hakkında Kanun'dur. 4077 sayılı TKHK. ile tüketiciyi korumaya yönelik mevzuatın bir araya toplanması ve Avrupa Birliği ile uyum açısından önemli bir adım atılması sağlamıştır. Ancak teknolojinin gelişmesine paralel olarak tüketim çeşitlerinin hızla değişmesi ve uygulamada karşılaşılan sorunlar nedeniyle mevcut düzenlemeler yetersiz kalmıştır. Bu nedenle 4077 sayılı TKHK. eksik ve yetersiz kalan yönlerinin düzenlenmesi amacıyla 4822 sayılı kanunla değişikliğe uğramıştır. Ancak günümüzde bu kanunun da eksik kalması nedeniyle 6502 sayılı TKHK. 28.05.2014 tarihinde yürürlüğe girmiştir. Böylelikle getirilen yeni düzenlemelerle hem tüketiciyi koruma alanı genişletilmiş hem de uygulamada karşılaşılan sorunların azaltılması hedeflenmiştir. Bu yüksek lisans tez çalışmasında, 6502 sayılı TKHK.'a göre ayıplı mallar ve hizmetler ile ayıptan sorumluluk konusu ele alınmıştır. 6502 sayılı TKHK.'un ayıplı mal, ayıplı hizmet ile ayıplı ifa kavramına getirdiği yeni yaklaşımlar çerçevesinde sözleşmeye aykırılığın sonuçları ve satıcının sorumluluğu incelenmiştir. | en_US |
| dc.description.abstract | Consumer Law is one of the fastest growing and increasingly important branches of law in recent years. The increase in consumption has necessitated the regulation of this subject and the renewal according to time. The first regulation on this subject was the Law No. 4077 on the Protection of the Consumer, which entered into force on 8 September 1995. This legislation has been an important step taken together to unify the scattered legislation on consumer protection and harmonization with the European Union legislation. However, in parallel with the development of technology, the rapid changes in consumption patterns and problems in practice have made current regulations inadequate and in the first place the Law on the Protection of Consumers No. 4077 has been amended by Law no. However, due to the shortage of this law today, the Law No. 6502 on the Protection of Consumers entered into force on 28.05.2014. In this way, the new regulation aims to expand both the consumer protection area and reduce the problems encountered in practice. In this graduate thesis study, defective goods and services and liability were discussed according to the Law on the Protection of the Consumer No 6502. The Law on the Protection of Consumer No 6502 has examined the responsibility of the seller and the amendments brought about the contradiction to the contract and the defective goods or services within the framework of the new approaches to defective goods, services and defective performance concepts. | en_US |
