Özet
Tez kamulaştırma bedelinin tespitine ve tescile ilişkin uyuşmazlıklar ve kamulaştırma işleminden doğan diğer uyuşmazlıklar olarak iki bölümden oluşmaktadır. Tezde uygulamada yaşanan sorunlara değinilmiş ve konu Yargıtay içtihatları ışığında incelenmiştir. Kamulaştırma işleminden doğan uyuşmazlıklar, adli yargıda dava yoluyla çözüme ulaştırıldığından, bölümlerde kamulaştırma davaları esas alınmıştır. Uygulamada önemli bir yer işgal eden kamulaştırmasız el koyma nedeniyle açılan tazminat davaları ise kamulaştırma işleminin yokluğunda açıldığından çalışmamızın kapsamı dışında bırakılmıştır.
Thesis is consists in two parts: one of the part is; the disagrements about determination and registration of expropriation price. The other part is; disagreements which derives from expropriation operations. The thesis spokes on the problems which arise in practice and the subject analyzes in the light of supreme court decisions. Because disagreements which arises from expropriation operations is solved in judicial juridicul, in parts the expropriation a ceses is the main subject. The compansutiur cuses which arise from confiscutiny without nutiunaleisutiun; is out of subject.
