Anayasa Mahkemesi’nin E. 2022/48 K. 2022/93 Sayılı Kararı Uyarınca İdari Yargıda İstinaf Dilekçesi Üzerinde ilk İnceleme

Özet
İdari yargıda istinaf kanun yolu, 20.07.2016 tarihinden itibaren uygulanmaya başlamıştır. 6545 sayılı Kanunla, 2577 sayılı İdari Yargılama Usulü Kanunu’nda istinaf kanun yoluna ilişkin yapılan düzenlemeler uyarınca istinaf, temyizin şekil ve usulüne tabi kılınmıştır. Dolayısıyla istinaf dilekçeleri üzerinde de temyiz dilekçelerinde olduğu gibi bir ilk inceleme yapılması gerekmektedir. Buna göre ilk inceleme, ilk olarak istinaf başvurusuna konu olan kararı veren idare veya vergi mahkemesince yapılmalıdır. Bu inceleme neticesinde ilk inceleme konuları bakımından bir eksiklik tespit edilmezse dosya istinaf mercii olan bölge idare mahkemesine gönderilmelidir. Bölge idare mahkemesi de ilk inceleme konuları bakımından inceleme yapmaya yetkilidir. Ancak İYUK’ta ilk incelemeye ilişkin yer alan konular ile ilk incelemenin usulü bakımından birtakım eksiklikler bulunmaktadır. Bunun yanında ilk inceleme neticesinde verilecek kararların niteliği, ilk incelemenin yapıldığı aşamaya göre değişmektedir. Anayasa Mahkemesi’nin 20.07.2022 tarih ve E. 2022/48 K. 2022/93 sayılı kararı ise istinaf dilekçeleri üzerinde ilk inceleme yapılması ile bu inceleme neticesinde verilecek kararlara karşı başvuru yolları bakımından yeni bir hukuki durum ortaya çıkarmıştır. Bu çalışmada da idari yargıda istinaf dilekçeleri üzerinde ilk inceleme ile bu inceleme neticesinde verilebilecek kararlar ve bu kararlara karşı başvuru yolları, mahkemeye erişim hakkı ve etkili başvuru hakkı ekseninde incelenmiştir.
The legal remedy of appeal in administrative jurisdiction has started to be implemented as of 20.07.2016. Pursuant to the regulations on theappealmade in theAdministrative Jurisdiction Procedure Law No. 2577 through the Law No. 6545, the appeal is subject to the form and procedure of the cassation. Therefore, a preliminary examination should be made on thepetitions of appeal, as in the cassation. Accordingly, the preliminary examination should be made by the administrative or tax court, which made the decision that is the subject of the appeal application. If, as a result of this examination, nodeficiency is detected in terms of thesubjects of the preliminary examination, the case file should be sent to the district administrative court, which is the appellate authority. The distirict administrative court is also authorized to conduct examinations in terms of preliminary examination subjects. However, there are some deficiencies in terms of subjects and the procedure of the preliminary examination in the Law No. 2577. In addition, the legal nature of the decisions to be made as a result of the preliminary examination varies according to the stage of the preliminary examination. The decision of the Constitutional Court numbered File No. 2022/48 Decision No. 2022/93created a new legal situation in terms of both the preliminary examination and the remedies against the decisions to be made as a result of the preliminary examination of the appeal petitions. In this study, thepreliminary examination on the petitions of appeal in the administrative jurisdiction and the decisions that can be made as a result of this examination and the remedies against these decisions are examined in the axis of the right of Access to the court and the right to effective remedy.
