| dc.description.abstract | 2547 sayılı Kanun ve Doçentlik Sınav Yönetmeliğinde doçentlik sınavına başvuru koşulları ve sınava ilişkin hususlar düzenlenmiştir. Dolayısıyla Üniversitelerarası Kurulun doçentlik sınavına başvuru koşulları ve sınavın yapılışına ilişkin olarak kanun ve yönetmeliklerde düzenlenen hususlara ters düşecek veya aykırılık teşkil edecek nitelikte düzenlemeler yapmaması gerekir. Doçentlik kadrosunda çalışacak olan kişiler, Anayasanın 128. maddesinde belirtilen kamu görevlileri arasında yer alırlar. Anayasanın 128. maddesinin 2. fıkrasında, kamu görevlilerinin çalışma koşullarına (atanma, nitelik vs.) ilişkin konuların kanunla düzenleneceği belirtilmiştir. Ancak, „kanunla düzenleme? ilkesi, her konunun bütün ayrıntılarıyla kanunla düzenlenmesi şeklinde anlaşılmamalıdır. Yürütmenin düzenleme yetkisi, sınırlı, tamamlayıcı ve bağımlı bir yetkidir. Anayasada kanunla düzenlenmesi öngörülen konularda, konunun temel esasları kanunla belirlenmek koşuluyla, uzmanlık ve teknik konular genel düzenleyici işlemlerle yürütmenin düzenleme yetkisine bırakılabilir. Bu nedenle üniversitelerin, doçentlik kadrosuna atanmada arayacakları koşulları, kanun ve yönetmeliklere aykırı olmayacak şekilde ve genel düzenleyici işlemlerle yapmaları gerekir. Kamu görevlilerinin niteliklerinin, atanmalarının ve Anayasanın 128. maddesinin 2. fıkrasında belirtilen diğer konuların kanunla düzenlenmesi kuralı, kamu görevliliğine alınacaklar için bir güvencedir. İdarenin bu konuda yapacağı düzenlemeler nedeniyle oluşacak hak kayıplarının önlenmesi bakımından önemlidir. | en_US |
| dc.description.abstract | The Law no. 2547 and the Regulation on the Examination for Associate Professorship specify the application requirements for this examination and the other procedures concerning the examination. That is why the Inter-University Council should not bring any stipulations that are in conflict with the terms and conditions set by the laws and regulations related with the application requirements and procedures of the examination. The permanent position of associate professorship is included in the scope of public employment defined by the Article 128 of the Turkish Constitution. The paragraph 2 of the Article 128 in the Constitution stipulates that the regulations concerning the qualifications and appointments of public employees shall be made by the law. However, the principle of “making by law” does not entail that all details of each topic should be set by law. The regulatory authority of the executive power is limited, complementary and dependent. The technical issues or the issues that require expertise can be put under the regulatory authority of the execution on condition that the basic principles are determined by the law. Therefore, the universities can specify themselves the requirements for promotion to associate professorship by general regulatory procedures without violating laws and regulations. It is a guarantee of the rights of prospective public employees to set the stipulation that laws are required to specify the qualifications, appointments and other procedures mentioned in the paragraph 2 of the Article no. 128 in the Constitution. This guarantee is of importance to avoid any loss of rights that result from relevant regulations of the administration. | en_US |
