| dc.description.abstract | Aynî akit, aynî hakların kurulmasında ve devredilmesinde uygulama alanı bulur. Türk ve İsviçre Medenî Kanunlarında aynî akit kavramı düzenlenmemiştir. Açık bir düzenleme olmasa bile, aynî hakların devredilmesi ve kurulması sürecinde aynî akit kavramının varlığı şart olarak aranmalıdır. Aynî akit, aynî hakların devredilmesi veya kurulması için gerekli olan zilyetliğin devrinin hangi amaçla yapıldığı hususunda iki tarafın iradelerinin uyuşmasını ifade eder. Aynî akit, hukukî işlem niteliğindedir. Zilyetliğin devri ile birlikte tasarruf işlemini oluşturur. Aynî akit, açık veya örtülü bir şekilde kurulur. Kanunda yer alan genel nitelikli hüküm aynî akit hakkında da uygulama alanı bulur. Aynî akit, sebebe bağlılık ilkesinin kabul edildiği hukuk sistemlerinde de uygulama alanı bulur. | en_US |
| dc.description.abstract | The contract in rem applies to the establishment and transfer of rights in rem. The concept of a real contract is not regulated in the Turkish and Swiss civil codes. Even if there is no clear regulation, the concept of a contract in rem should be looked for when it comes to the transfer and establishment of fundamental rights. The contract in rem describes the agreement of intent between the two parties regarding the purpose for which the transfer of ownership is necessary for the transfer or establishment of rights in rem. The real contract has the character of a legal transaction. The contract in rem together with the transfer of ownership forms the disposition transaction. The real contract is concluded either expressly or tacitly. The general provision in the law also applies to the contract in rem. It is also used in legal systems in which the principle of causality applies. | en_US |
